Hello

I have been reading the forum for a few days now; personally I went BR in June 2006 and was discharged 12 months later. The reason; I was feckless and stupid when it came to money, banks and all that jargon they throw at you! So 99% my fault but the 1% of it belongs Natwest for making ti too easy and when asked for help because I was struggling their solution was take out a loan!!!.

Any way my questions are;

1. Now, I am discharged; I have obtained my credit file to try to repair some for the mess I got myself into. However before I was discharged I live at two different addresses. The old one when I went BR and the one I live at now. So my bankruptcy is linked to two addresses, does this mean the bankruptcy will follow me around to every single address I live at forever? The next 4-6 years? Or will that stop now I am discharged?

2. I had a loan and a credit card with Natwest. The loan shows up as being satisfied but the credit card which was included in the SoA, shows it still in default. Natwest do have a copy of the SoA, which I personally took into a branch after the BR. Can I get that changed to satisfied?

3. I am leaving my job and life in London and moving back home to the north of England to make a fresh start. I haven't got a job and I will be living with my parents until I have sorted myself out. Whilst I do not have a job, can the OR force me to continue making payments IPA? Additionally when I return to work, will the OR make me continue paying to the IPA for the full time of the agreement?
i.e. I started paying in august 2006, (I haven’t missed one) so my last payment would be in august 2009 (I hope I’m making sense?)

4. On a personal level and from the heart, what is the best way to explain to a boyfriend who you met before the BR, about the BR and how it happened and that you have learned your lesson the hard way? Soppy question I know, but I am ashamed of my actions even though I asked for help from Natwest when I couldn’t cope (as all these experts tell you to do) and as I said above, it was a loan or nothing else!

Hi Dolly and a very warm welcome to you.

I will try and help with some of your questions although i dont have extensive knowledge and can only offer limited advice.

So here goes, as for the credit file i am not sure on that one. I believe there is a way of writing to the companies after discharge to ask them each to place your account as satisfied or partially satisfied, another member on here Skippy wrote about that in here blog, so have a look.

The IPA bit, you would have to get a new I&E sheet from the OR and put all the information on there, as for if it will stop early is up to the OR only.

When it comes to your OH then if you have a great relationship that is trusting and honest then i would say tell him, there is no easy way of saying it, but you know how you are as a couple and maybe you could judge the right moment in which to just explain it all as you have on here.

We have all made silly mistakes, i went BR on the 4th of August so im still new but like you it did not help the banks throwing ot at you, then when you needed help towards the end they did not want to know.

Good luck with it all, i hope that i have helped a bit and maybe some one else can come along and help a bit more about the credit file thing.

PS Dont beat yourself up over it, whats done is done, you did what was right and now your on the right track :-)

Hi Dolly,

Entries on your credit file (be it BR, CCJ, default etc) only stay on there for 6 years. If you wish to update your record now your discharged, you can apply to the court for a Certificate of Discharge (about £60) which you can send copies to the credit reference agencies.

With regard the IPA, you have a duty to inform the OR of any change in your circumstances. The OR can then increase/decrease your payments accordingly.

I met my fiancee shortly before I went BR. From experience, I found total honesty is the way to go. If they don't understand, then they're not the one :)

Hello,

I went bankrupt in NOv 07 and am due to be discharged in Nov 08.
When I was thinking about going bankrupt, my financial adviser told me to send a letter to all my creditors with a change of address (a PO BOX which she had provided me) so that I would not receieve any nasty letters. So, i did this. However, I couldnt get a Co-op account because of my credit check and something at the last address I was at - you've guessed it - the one i sent to the creditors but didnt actually live at.

So, after advice taken on here, I sent off for my credit report and included a letter about this address and the fact that i had never lived there and could they correct it.

I got my report back, this address is all over it, and all of my creditors have that as the address - so I am guessing there is no way they can change it then - as they put nothing on there about this 2 page letter i had sent them explaining it all!

My questions are: (as Dolly asked as well)
Does the Bankruptcy status stay with you at each adress?
If you have a Nationwide account with two different accounts, one is a credit card which was included in my bankruptcy and one is a flexaccount which was Joint with my mum and they have said i can use the flexaccount - is there anyway that they can make me pay the Credit card? Is says default on my credit file - not satisfied...

So, basically when I am discharged in 6 weeks, i should get my Certificate of Discharge/Satisfaction - send it to the Credit Agencies, and to all of my creditors along with a letter saying can you inform the Credit Agencies that my account is now satisfied? This right?

Hi 369,

From what i understand i would get your disharge letter or pay for a cert currently about £60 and send a copy to each of the credit ref agencies and inform them that you are now discharged and ask them to update there records accordingly.
I am not sure about the Will the credit file stay with each address but i would have thought it would do as that is how we are linked into their system.
They always ask for previous addresses for somethings and i think that somehow they will go with us.
Not sure if im 100% right on that bit but that is my understanding of credit files and reports.

I haven't got a certificate of discharge, I've printed the entry from the Insolvency Register showing that I'm discharged.

The creditors who have replied to me haven't had a problem with this.

Tomorrow is a mystery, yesterday is history, today is the present, a gift to make the most of.

Thank you all for the replies and the kind words also

I have another question, can parents find out my BR in way (I'm not longer on the online register), for example if they decide to request their credit file whilst I am living at their place till I get my own flat.

Additionally, the OR can't force to make paymenst if I am not making any money at all (I'm not eligable for state handouts), so my parents would be feeding me, etc
