Hi,
Was just wondering if I could have some advise. We have been advised to declare bankrupt, however I have not been paying the unsecured debt since September. We have been getting constant phone calls which I have been ignoring. We have decided we do not wish to remain in this house as we have such negative equity and I do not like where it is so we have been told to wait two months not paying the mortgage before declaring bankruptcy. Basically anytime after 11 November. I would like to do it 1 December. Is there anyway I can buy time with the unsecured creditors whilst I wait two months for this date as I am sure they will take further action in this time.

All i did was to inform the creditors that i was in need of a bit more time to get legal advice and would be in contact once i was sorted.
I gave them 2 months in which i would be able to be in contact for us 1st Sept and told them 1st July.
It bought some time but did not stop the letters or calls.
Other than that i dont know what else to suggest.

Hi if you only missed September payments it is unlikely that any creditor will take any drastic action before the beginning of December. They all huff and puff a great deal but they need to follow due process. Having the hassle isn't great though so if this is the first time you've missed a payment offer the creditors £5 or so a month each, it may work, they may want more, but if you ignore them, which is your choice if you wish so to do, the hassle will continue and likely increase.

Do I write and offer this to them or say over the phone?
Also we are looking at Rental properties currently but the agents do Credit Checks if you go ahead, obviously they will be bad what happens? |
