I shortly have the possession hearing for my home. I will be going BR shortly. Do I need to attend the Possession hearing. I assume they will go through the motions even if i am not there. ie. 28 days to pay in full before an order for eviction.
You are leaving your home i take it when BR. If thats the case i dont think you have to attend only if you intend to fight ur case and stay and then try and sort out arrears etc. If you are hoping that it will go to repo and are not bothered about the outcome then yes they will go through it without you there and then it will be a few weeks later that you will have to vacate. If it is your intention to stay on then i would suggest that you if you can attend and talk to them, but thats only if you want to stay if not i would just leave it. It may look better though if sometimes someone can attend it is more professional if you can be there but like i said i dont think you have to be.
Dont know if i have helped at all. If im wrong it will be corrected.
Take care

Sorry to hear about your situation, i think a lot of us are in the same boat, I dont know whether it would be best to attend or not. Out of interest when did you miss your first payment and who is your lender?
there's no need to attend the hearing unless you plan to somehow clear the arrears and stay in the property. The judge would then decide if your scheduled offer to clear the arrears was acceptable. As you're not staying in the property the judge will agree repossession either way so no need to attend in your case.
Thanks for that people. I am now prioritising getting my possessions out of the house and into storage. I don't own anything of any value (as in £500+). But want keep as much as i can. Business is poor, as is my health which continues to trouble me. I have a GP appt tomorrow to discuss my health (I already have a number of ongoing chronic conditions) as I believe i am struggling to cope now. I need another medical for work in November and i doubt i will pass it. This will mean instant unemployment.
Mortgage is through rooftop and i missed my first payment in june.
Hi i also thought your possesions would be safe when BR unless you had things of real value like a 50" top of the range Plasma tv worth about £1000 or more.
Am i wrong anyone as now i have started to worry.
