i went bk on 2nd oct i moved into rented property on 1st sept as i split up with my ex...the property i jointly owned with my ex partner and have missed 3 payments on and we were going to let go to repossession the mortgage company put a mortgage cousellor in touch with him and he has arrange for the arrears to be added to the outstanding morgage balance and continue with the mortgage payments as he has now decided to stay in the property.there is probably about 5k equity....would the or have to allow him to stay in the property and if so how long would he be able to stay in the property and would the or be able to force him to sell....when we put the property in joint names last sept my ex signed all the equity in the property to me as i had orginally put down the full deposit..

any advice appreciated as always..thank you
