 Im going bankrupt,

Im going bankrupt, all the debts are in my name except 1 which is a joint bank account, they tried to obtain the money off my wife and issued her with a CCJ. And now they are trying to get the money off me in just my name. When i go bankrupt will this be written off or will they still try and get the money off my wife? Also are they allowed to split the account into seperate names to try and get the money from us?

Hi Ijg and welcome

Firstly if the debt is now only in one name yours then technically it should be absorbed by the BR but unless it is def only in a single name then the chances are they will still look to your wife for the monies.

Have you resigned anything transfering it over.

Hi
if you are the only one declaring bankruptcy then the CCJ against your wife will remain valid and she will need to keep to the payment schedule, and for the full amount of the debt, not just 50%.
