Hi All
I never went into an IVA or DMP before going BR i did my own negotiations with the credit companies and sorted out freezing interest and lowering my payments without using a company or going through the courts. My question is.
When you enter into a DMP or IVA i believe that the agreements are made with all creditors present and have to agree to the payments proposed by the debtors company representing them, and then if they agree and i know it has to be a majority then it will all go ahead, but when BR does the OR have meetings with the creditors and put the case forward or is it just a case of writing to them and stating that the debtor is now BR and this is what I propose, obviously then the details of assets and any proposed IPA will be known to the creditors.
Also can the creditors try and stop the BR even after the court have declared this, and then try and overturn it for their own gain.
Any ideas as i was just wondering thats all how that part of the process goes really.

I'm not sure about what meetings they have with creditors etc but I'd be surprised if the creditors have any say really. I'm not 100% sure but wouldn't they just have to accept what they get? I know the OR writes to the creditors again towards the end of their investigations to see if any of them have any reason why they shouldn't conclude their investigations (ie to see if they know anything important about you that the OR doesn't-they've found out you have £1000s in savings for example!). I'm sure the creditors can't do anything to overturn the court's decision for BR at this stage.

Yeah im getting there slowly. Nose still bunged up well my sinuses.
Kids r off to school in a mo so peace and quiet for a few hours. LOL

Glad you're getting better. I'm the other way round with the peace and quiet-little one's still asleep at the mo but will wake soon, and then my peace will be shattered!!! :-)

Mine's only 2. Bless.
I know all about twins! My brothers are twins and one of them has twin girls, just gone into year 10. I also know lots about 15 yr olds, being a secondary school teacher! Is your 15 yr old in yr 11?

Yes he is, he also has aspergors and is hoping that his disability wont distract him from getting into college next year.
He is a lovelly lad, but because of his aspergers he has no life, he has no friends and no confidence.
I want so much to try and get him more confident and want to go out but he does not want to, in a way thats a blessing as i know he does not get into any trouble but the same time it is not the life i wanted him to have, he should be out there like other teenagers getting into mischeif within reason and living life to the full, he is very bright but because, as you know aspergers is a type of ADHD and also Austism its hard to help him.
I think with the help i give him and also the extra he gets from the SENCO teachers and helpers we will get there, and get him into college next year, i know they help students with learning disabilities.

Bless him Jo. Is it severe aspergers? I've taught several students with aspergers, and as you know the spectrum is soooooooo huge that the severity can go from it hardly being noticeable, to it meaning the person can struggle to have a conversation or read expressions and body language etc. I taught a lovely boy with VERY severe aspergers a few of years ago and as you know one characteristic of aspergers can mean the sufferer develops obsessions. Well this lad became fixated on me! He would stare at me all through assembly and had this thing about my curly hair! He loved music and went to a youth club where he DJed and his 'stage name' was my surname, bless him! In fact I bumped into him at the supermarket last week. He's 21 now and was out shopping with his dad. He came running over and shook my hand, stroking my arm over and over again, and he told me he still uses my name as his stage name! BLESS. He is so lovely but I know what a struggle it can be. He went to college too and is now going back again to do more work. I think alot of what he's doing is 'life skills' type stuff, but he'll be ok, I'm sure. He seems to really have grown in confidence since he left school and has learnt some good social skills.
It is tough though and I have some idea of how tough it must be for you too. I know we're totally off the BR topic (sorry all!!), but if you do ever want a non-BR related natter, I'm always around on email etc as you know.

Yes it is severe, although when you look at him you see a strapping 6ft lad that no one can see inside and see there is that problem.
He has his obession and its 2 things music and also the simpsons, but its hard when his brothers see a bigger lad but mentally he is the same age, he acts like them and seems to mimic the things they do. He forgets he is twice the size and they play games like 9 year olds do, but as he is so big he can get a big rougher, i try not to make an issue of it, i know he cant help it. I understand more of what he is going through, as one of my essays for uni was for a cild with the same and i read about written by a child with it and when i finshed reading it i asked him some of the things this author had written about in his life and it was a bolt from the blue, so many things, he cant look straight at me, i always thought he was being awkward and rude but i know now that he just cant, he likes things to stay the same, thats why we stayed here, the twins will adapt easier our eldest will find it more difficult to cope when we have to go, i have got hubby understanding more now about how he feels and my son and i are a lot closer. Again sorry its not about BR but it is a part of my life and it is nice to share my life with others too no matter what its about. I feel like i have done something wrong when i think of him, like i could have done something, but i know it is not my fault, i must be there and guide him through. I think he knows there is something going on, but we dont tell, i want him to feel secure, thats another reason im not working at the moment, i know all 3 need me but out of all of them he needs me the most, he needs reasurrance and stability and to know that things are normal.
I will try and get admin to email my address over and when i need a chat i will contact you.
