Hello,

Me and my boyfriend used to live in UK and that is where he still has a lot of debts (over GBP 18,000).

To start a new life, two months ago, we moved to Luxembourg, when new job opportunities appeared.

He was trying to pay off the debts while we were still in the UK, but even from Luxembourg, and having better jobs, it is still impossible to meet the payments necessary to pay them off.

He has now realised that bankruptcy is the only option left.

Unfortunately, because we are not in UK anymore, the insolvency company from UK can't help us (we contacted a number of agencies) and apparently the only way is to apply for bankruptcy from Luxembourg.

We have no idea how to deal with it without going through an expensive lawyers services.

Neither of us speak french, and it is too embarrassing to ask anyone for help.

My boyfriend keeps searching Internet for any information but with no result so far.

Can anyone help us?

Hi Asia,

Although I don't have the knowledge to advise you, there was a similar thread a few weeks ago which could help you. If you do a 'search', the post I am referring to is entitled 'declaring bankruptcy from overseas'. Have a read of it and see if it helps.

Thank you BankruptC,

I have read the previous post. If we could arrange a Lasting Power of Attorney for one of the agencies that would be an ideal solution but, we have got confusing information about it...

Is it possible to do it from Luxembourg, since it is a part of the EU?

Also we have read on one of the website that we have to do it within the first three months from the time we have moved. If that is the case we do not have much time left.

Hi again Asia,

As I said I don't have the knowledge to help you, but if you keep checking back over the next day or so, someone may well be able to help you, although the forum does tend to be quieter over the weekend.

Failing that, I'd recommend you phone the helpline on Monday morning and see what info they can give you.

Hope you get it sorted as I appreciate what a worry it all is.

It is really difficult and here seems to be even more complicated without friends and because of the fact that every government document is in french.

You have given me some hope and I will wait for more replies.

Hi
currently the Insolvency Service take the view that quote " as soon as you step off the plane in another EU country you must petition for your own bankruptcy there".

Therefor it is not possible to petition in the High Court in London while residing elsewhere in the EU.

I would suggest that the best step forward would be to google bankruptcy in Luxemborg and phone up several of the listings until you find a lawyer that speaks English.

You should however be wary and really do your homework about Br and its impications in luxemburg before proceeding. They will no doubt be very different there to the UK.
