hi, my husband and I are declaring ourselves bankrupt on Tuesday. i put my name on my mum's bank acts 3 months ago when she was having an operation as she said if she died then i could have quick access to her money. thank god she didnt however 3 weeks ago i have tried to get my name off acts, i will be declaring this on BR form, but dont want my mum's money put at risk. she got it in her uncle's will a few yrs ago, and never gave me cards or access to the money, etc. so wondered will the OR freeze her acts as i dont think this is gonna get sorted before BR day-do they freeze acts imediately? also one of the acts is at the same bank i have a loan with. really worried as she will need access to her pension which goes in that act, and i didnt really want to tell my mum my plans. help! need advice asap!

Hi
the acct may well get frozen but all you need to do is show the balance prior to your name being added, evidence that you have made no deposits yourself, explain why this was done. The OR will then do all he can to advise the bank he has no interest in the acct. I've no idea what the bank may do in respect of the money you owe them but legally they are not entitled to touch what is clearly your Mum's money.
Sometimes, I should warn you, banks don't adhere to or even know the law. If they try it on you may have a fight but the money can clearly be proven to be your Mum's.
