Hello,
Since I live in London, I may have to present my Bankruptcy Petition at the Royal Courts of Justice in The Strand.
This sounds rather daunting, does anyone have any experience with Bankruptcy in the above courts? and how do they compare with regular County Courts?

Firstly the amount of people at the court will be far more. Also if there is a rather juicy case going on, then there will be a lot of activity and possibly photographers on the steps on the way in.
Outside of the Big Smoke - it is all a little quieter. In some of the courts you have to book in advance to go BR, whilst in others they have a drop in session. As long as you arrive by a certain time you will be made BR that day.
The procedure normally is, that you go to the reception desk and explain why you are there, they will then direct you to the relevant section. You hand over your BR documents (in some cases 3 copies) and the fees. Then just sit and wait. You will then be called into an interview room, where they will ask you to swear on the bible or similar. A log is filled out with your details, and then your Statement of Affairs is read through and at the end your will some some documents. 10 minutes later you leave the room.
You are then asked to wait for the judge. In rare occasions the judge may ask to talk to you, if he has a question. Generally though the next thing that happens is you are given a copy of your BR docs back with a court stamp, and also your BR number at the top. You will also receive a receipt for the court fees.
In some cases you will be asked to wait while the courts fax the documents over to the Official Receiver, after which you will have a brief interview over the phone. Or you will be informed that the OR will be calling you within X number of hours to interview you over the phone.
For simple cases you will just have a telephone interview, and then not hear anything again other than my mail. More complex cases and often if you are self employed you will be asked to attend a face to face interview.
The whole process at the courts can take anything from 20 mins to 4 hours. The delay is often only due to the fact that the judge is very busy and you are waiting for him to stamp your paperwork.
In general most people say they were terrified about attending court, after the event they wonder what all the fuss was about!!!
Maybe in your case you could attend the courts before to familiarise yourself with the layout. You can also take a friend. |
