Hello,

I went bankrupt in Nov 07, and i am due to be discharged in just under 3 weeks time...

I had a FlexAccount and a Credit Card with them. The Credit Card was in my name, and the FlexAccount was joint with my mum as i went travelling and wanted her to have a card and authority whilst I was away. When i went bankrupt, I thought both accounts would be frozen.

I found out in June this year that the FlexAccount hadnt been frozen as it was in Joint names, so i have now been paying off the overdraft so that i can use the account again...which i will be able to do from next week as my wages will be paid into there, the overdraft clear and i will be in credit.

My question is... is there anyway at all that they will be able to take money out of my FlexAccount to pay off the Credit Card account -as both accounts are still showing up on my internet banking.

I asked the customer services people and they said no we cannot take from one account to another account....but i just wanted to see if anyone had ever experienced this? Wouldnt it be seen a preferential treatment...if I was "seen" to be paying off my Nationwide Credit Card?

If the debt was included in your BR you aren't allowed to pay it off.

Thanks Skippy....

Im not saying I would pay it off....I was wondering if the bank can pay it off? So take money from my FlexAccount (not included in BR) to pay for the Credit Card (included in BR)?

Basically can they touch my FlexAccount money?

Sorry, I've just read back what I posted and it sounds really rude and abrupt - it wasn't meant to be! I also misread your post - I'm posting from work and have to come out of the screen if anyone is around!

The bank isn't allowed to take money from your Flexaccount to pay off the credit card as it was included in your BR. That doesn't mean they won't do it though so I would be careful about using the Flexaccount. It might be worth paying a small amount in and seeing what happens...

i didnt take it to be rude, so dont worry and i didnt want mine to sound rude back!!! im at work as well and have to hide the screen!!!

i am actually getting my wages paid into the account next week.

i am being discharged on the 2nd nov - so can i send them my Certificate of Discharge and then they can just get rid of the Credit Card account off of my internet banking?

I did ask the Nationwide Customer Service team and they said they wouldnt/couldnt take the money....

hmmm bit worried now....

Im with Skippy on this one, they are NOT allowed to take funds to pay off this debt.

It was written off in the BR and it would be breaking the law to take the funds now.

I hope that you enjoy the new future that is about to truely start for you and if you need us please give us a shout and dont forget to keep on replying where you can as your experience will be helpfull also.

You could send a copy if you so wish, it wont do any harm, if you do however send it with proof of postage and one to be signed that way you have it for your records.
