My father in law was last week informed that he is terminally ill with liver cancer with just a few weeks to live and he has asked me to sort out his affairs. From the paperwork I have been given it would appear that my father in law was made Bankrupt on 7th June 1991. A caution is showing on the title deeds of his home which is dated the 30th May 1996, the caution has been put on by Cape & Dalgleigh who were the trustees appointed by the Official Receiver. There is also contained within the papers a Court Order dated the 20th August 1997 in which the Trustee obtained permission to impose a charge for the benefit of the Bankrupt's estate in the sum of £129.921.54. This charge is, however, not showing on the Charges Register. I need to ascertain (a) whether the charge order is effective even after all this time and when it does not appear on the charges registered. I also need to know whether it is possible to have the caution removed and, if so, what steps I can take to have it removed. I await to hear from you. Many thanks
In cases like this i would recommend giving our helpline a call, the number is free and then we can give you a more one to one approach as i think we need a bit info and you cant always answer things like this on the forum, as they are a bit more complex, if you understand what i mean:-)
