Dropping into the local (Northampton) court on Wednesday this week to finally do the deed! (Both me and my wife.)

So, what will I need to take? I know of the moneys involve (just under a grand) and the 3 copies of the forms each all signed.
I'm guessing some form of ID will be required, but anything else? Bank statements or anything?

Hi

no you need take nothing else to court.
The OR is the one interested in statements etc and he'll let you know which ones to send in during your interview.

Marvellous, thanks.

I think we're about sorted: the first thing we need to do on Wednesday morning is to go and empty our bank account otherwise we're going to be unable to live :D Go through with the deed, then get back & give the Co-Op a call to open our new account. Will be fun. In hindsight really I should have done this next week, so I can get hold of a babysitter! Don't fancy putting our 2 months old baby through all of this, nor would I think the court would appreciate him being upset :)

Just wanted to wish you both luck for wednesday.

Your little one is very young and will not understand what you are doing. I realise its not the best situation and they pick up on things, but once its done he is going to have his mummy and daddy more relaxed - just keep thinking your both doing the best for your family.

Now just another one. Having checked the forms over for the third time I'm now a little paranoid about the contents. Not the whys and wheres though; they were done on the Insolvency website, so other than signing and dating twice now (one on page 2, the Petition and once on the back of the Statement of Affairs) is there anything else I need to write in? I assume the affidavit bit is only signed at the court with the (whoever) as your witness?

Yes, leave the signing bit till you get to court....the insolvency clerk who was dealing with me signed it too.

Have you submitted them yet, or are you delaying it like me until the last minute. Make sure your ink doesnt run out though - i had to make an emergency trip to the shop!

All done - printed 3 copies for each of us, signed all - that's 200 sheets of paper and a lot of ink! Actually bought a printer from Morrisons (HP multi function printer, £30, worth a look if on a budget!) earlier this week mostly for this purpose and for all the CV's I'll be doing soon :)
Will, won't be long now - 9:30 we were told to be there by, now coming up to 7:30. Dropping baby off to my mums to babysit, then need to go and find somewhere to park in northampton! Then I've got to hopefully be back here in time to start work from 1pm till 10pm! Long day :(

Dont sign anything! It has to be done at court and witnessed. I think this may be a little late now.

Very annoyed. Turned up half an hour early as instructed, went to the allocated place, waited for 45 minutes, then when I enquired about the wait and why we had to see a welfare officer first, I was informed as we'd already sought advice and the forms were done, we could go straight to the desk downstairs to go through it all.
So we did, another 20 minute wait downstairs, signed all the forms - we didn't need 3 copies, they did those there for us (wasted paper and ink!) handed over £990 - then told we'd hear in due course about the hearing date!
"Excuse me?"
"Yes, you need to come back for a hearing"
"I was reliably informed it would all be done today"
Apparently, because our failed IVA went as far as the meeting of creditors which takes place in court, it makes matters more complicated hence going back at a later date. We didn't even make any payments to the IVA, it never started :(
I did ask if that was absolutely necessary - we're now flat broke, it costs us £10 to get to Northampton, costs us £5 to park, costs me a days wages of £64, costs time having to find a babysitter. Very, very upset. But now it's out of our hands. I wish the court actually informed us of this in the first place, along with the CAB, both of which knew about the (failed) IVA.
So all in all 3 hours of mucking around the very badly thought out and awfully signposted Northampton Combined Court and we feel like our time and money was wasted. But it's not all bad - a lady was there just before us had missed her hearing by 10 minutes - she was late on the motorway as it was having to come up from Croydon, but to rub salt in the wound the court was so badly signposted a) she couldn't find the court and b) once there took her 15 minutes to actually find where she needed to go!
Poor soul!

So you have to wait now and see when the actual date of the hearing is.

Like you have said what a waste of time and money.

Sorry to hear about your day - especially after you have got mentally prepared for the day.

Without the letter of termination from the IVA company ( even if you haven't made any payments) the court often don't process the petition and will write to the IVA company to ensure that they are aware and see if they have any comments. This usually takes 2 - 3 weeks. It is then possible that you will be advised of the new hearing ( a formality) when the petition will be granted.
