not sure how this all works i thought id already posted a letter but nothing has come up so im trying again. here goes. hi me and my wife have paid 850 pounds to a bankruptcy firm and they told us to stop paying everything ie mortgage and other secured loan plus household bills this we did but this morning we got a letter from the council tax with a date for us to go to court. can this happen. please help we dont know what to do. thankyou.

Hi

You should not have stopped paying utilities or secured lending if you intend to keep your home. What was the £850 for?
Unless you are already bankrupt you do not yet have protection from your creditors and they will chase you.

the 850 was for the bakruptcy firm charge, we do not yet have a court date for the bankruptcy. we dont expect to keep our home.

Hi and welcome

Do you want to keep your home. Do you have lots of secured lending against your home.

What other assets do you have?

What is your total debts?

Is there any equity in your property. Who did you pay your fee to and what are they actually doing for you.

Do you have any Disposable income left per month.

Have you thought about an IVA or DMP.

hi jo. we have no equity in our home. harrington brooks are the firm who are dealing with our bankruptcy and they charged us the 850. they told us to stop paying everything. we had monthly outgoings of 1,240 and incomings of 1,250. we yesterday went to put are names down on the council list

the secured debt is 80,000 more than the house is worth.

Ah right ok,

You should still continue to pay all essential debts like water, council tax, telephone, electric and gas etc.

The creditors you can stop paying and use the money to save up.

What service are these people providing for you, if you dont mind me asking. And did they go through all options with you.

Would you like to stay in your home if the mortgage payments are not too high.


Your unsecured debts what are their values.

Sorry for all the quesitons again, but you have been given advice that does not make sense and if you have stopped paying all your debts including utilities then that information given to you is wrong.

I think you should certainly get a second opinion as it seems very strange advice.

Please try and answer jo's questions (if you know the answers) or add some more details and someone will be able to help further.
