Bankrupt 15th August 2008 at Portsmouth Combined Court

Telephone inteview 18th September 2008

OR's Office Southampton

IPA of £63

NT Tax Code to be implemented.

2 adults although expenditure was based on one person.

Bankrupt 29th March 2007 at Kingston upon Thames County Court

Telephone interview 10th April 2007

OR's office Croydon

BR notice printed in the Surrey Herald

IPA of £186

No NT code IPA as filed so late in tax year

Only me going BR although I was allowed food budget for 2 as I pay for all of it as part of my contribution to the bills

Discharged 29th March 2008

bankrupt 9th Oct 2008 hastings county court

Telephone interview 16th Oct

OR office-whitstable

No IPA as on Benefits only

Expenses based on 2 adults and 2 kids

Told we will get a BRU but early days yet so still waiting

from thinking to actually phoning to arrange court appointment 4 months
court appointment 2 weeks later !!! very busy
filed 25th sept 08 hull
OR meeting 11th oct 4.5 hours long including coffee and cig breaks
ipa £180 variable as commission based review every 3 months
nt estimate £580 again reviewable every 3 months
discharged we will c over the coming months x

From time considering BR to filing 6 weeks.

BR on 23rd October 2008.

OR office Bournemouth - telephone interview 24th October.

NT code IPA - heard nothing else yet!!

Waiting to hear about car - OR gave value as 3,300 and asked us to send in valuations as we got much lower (2,450-2,700)still waiting to hear.

Yes they are all really nice and it was over very quickly. I didn't see the judge, nobody did that day, I don't know whether thats the norm though!

My OR in Southampton was lovely, very calming, very understanding and didn't make me feel like I had done anything wrong.

Mine only went in the London Gazette and the Portsmouth news but its up to the OR to decide which paper(s) it goes in.

Telephone inteview 21 October 2008 (1 1/4 hours)

OR's Office Chester

No IPA (Only hubby works)

2 Children, 2 adults.

Hope you dont mind me adding next bit Jo....

Local Paper it went in was Liverpool Daily Post


Onwards and Upwards is the way im going :-0)

From considering BR to doing it 3 months.

Went BR on 13th October 2008 at Birmingham Court.

OR interview 29th October 2008 - lasted approx 1 hr (+ 1 hr for hubby).

2 adults, 1 child.

I kept my car (I valued it at £2,700 - OR said if agent thought it was worth that I could keep it - had my letter yesterday to say I can - chuffed!).

Husbands car went, which we expected, £2,000 received back from OR to purchase another one.

As house in neg equity we would like to buy the BI back from OR - trying to get an Estate Agent valuation at mo.

We will have a NT IPA, however, we are just about to inform OR about reduction in mortgage payment by a substantial amount so we will probably have to pay one.

Hello I was wondering I am considering bankruptcy and also have a flat in negative equity, what do you mean when you say you "would like to buy back teh BI back from OR" how much does that cost and what is it?can you continue living in your home?

also as for printing in the paper, do they just put a few lines in the back of the paper about you normally or is it more?

Hi

if your property is in negative equity you are perfectly ok to keep it on 2 conditions.
First is that you can keep up the mortgage repayments. Second is that you or a 3rd party have sufficient funds to purchase your beneficial interest in the property.

I believe from your posts on the main forum the mortgage and property is in your sole name.
The BI, which for the moment belongs to the OR, will cost whosoever buys it £1 plus legal fees.
If you are a sole owner the legal fees will cost a 3rd party approx £500.

If you personally buy the BI the above costs will be the same but you, not if a 3rd party makes the purchase, will be required to pay what is known as an Ad Valorem fee which is 1% of the property value.
Therefore a 3rd party purchase is much cheaper.

Once you are discharged you can arrange through a solicitor to have the BI transferred back to you.
The 3rd party therefore needs to be someone you trust implicitely as once they own the BI you cannot force a later transfer. If this were the case then although you continue to be liable for the mortgage repayments any equity accrued in years to come would belong to the 3rd party.
Effectively therefore you would be renting the property.
