Went BR last week & credit card companies are now calling saying they will still send baliff's around to collect goods to help recoup costs. I was under the impression this cannot be done am i right or are the credit card companies still entitled to do this? This is already a very stressful time & not sure if my wife is going to take much more with a 6 month old baby. She is very worried that the heavies will just come in & ransack the house.

Hi there and welcome

I can completely understant your wife's concerns, but, you are now protected from any creditors. I would think its an idle threat anyway.

If you or your wife are up to it, why not give them a call or even take a copy of your bankruptcy order and send to all creditors (as a goodwill gesture). This should stop contact from them once it filters through to the mailing departments - it certainly worked for me.....I went BR on 13 oct. and not heard a peep since.

Hi PJM

No they cant do this, i would inform the OR as soon as you can and get them to deal with it.

The credit companies like to try allsorts to scare you to get there monies and now that your BR your protected by the court.

Make a note of who they are and inform the OR asap.

You could also mention about:

Section 40 of the Administration of Justice Act, that should get them off your case.

Dont worry, thats what we are all here for to help each other out.

We cant be expected to remember everything and the emotional support is a much of an importance as the legal and technical stuff.

And i know that we all do a great job on here, supporting each other and backing each other with info, thats what friends are for. To be there.

Hi pjm

ask them for their full name and advise them that the official receiver will no doubt take legal action against them for harrasment.

it is such a shame that immature people often spoil the reputation of banks in representing them in such ways.

i am sure that the CEO would sack them on the spot.

If only they had as much confidence in giving you their name.

you could of course complain and confirm what time the call was made and ask for a copy of the conversation - which will be taped.

Hi,
I had a phone call from a HSBC call centre a few months ago, which was very very nasty, after a few heated words i put the phone down, the next day i phoned the complaints dept. who investigated it, ( but unfortunatley they said the call was not logged ) yeh right. maybe closing ranks ?.

Hi Guys

I know where your coming from, i had the same with Lloyds TSB and Robinson Wey they were just so aggresive and made things up which i know is not the truth now, but at the time i thought that i would get debt collectors on my doorstep the next day, or they could go for a charge straight away. That is not the case they have procedures to follow, and i know they have to get there money but to bully us is not on.
I never once ignored any of my letters i contacted all of mine, so i felt like that did not care.

These banks etc have too many depts and not one of them know what the other is doing.

Well i dont really care now, if i could pay them back i would and even now i would if i could, but they are insured against their losses and they have no empathy or compassion when it comes to us and our debt problems. They only have one interest at heart and thats to balance their books, sod the rest of us.

Thats my opinion only.
