I really need some advice as I may be in a really bad situation...
We were declared BR last Tuesday (18th) which was a relief. I asked my wages dept at work how much notice I needed to give them before payday to notify them of the new account I needed my wages to be paid into as the usual acct will be frozen, they said 24/48hrs.
Coop have been dragging their heels so today I contacted work (as I am signed off with bad back at the mo) to see when was the latest time they needed new details before this month payday Friday (28th). They said wages were processed this morning so nothing they can do!!! A little more than 48hrs before payday I think!!!!!
I am now panicking as if my accounts have been frozen can the wages stil go in? If they havent been froen yet but money goes in and they are frozen at the same time I will have no money to live on next month. Will the OR allow me to have my wages and understand the mess up even though the account is on its overdraft limit & frozen? Can I take the risk & do an immediate bank transfer of all the wages (if acct not frozen yet) into my parent acct???
Really feeling sick at the moment worrying where do I go, what do I do as without my wages we will loose everything!!!
Any help/advice would be really appreciated.... |

I dont know how long it will take for them to freeze the a/c's. All I can explain is what happened with some of ours. The OR said they would freeze one that my OH had with her brother, todate they have not done (we went BR on 10th Sept so they have had plenty of time). They froze one of mine and I had someone trying to pay into it. As it was frozen they payment in was rejected and sent back to the payee. The Nationwide a/c was frozen as they saw the notice in the London Gazette (they must have some sad sod looking everyday) The OR said they had no interest in it and it took me about 3 weeks to thaw it out again, (lift the freeze I mean) I am sure one of the experts will advise shortly. |

If these are your wages and you need it for essential living expenses then I cannot see the OR being interested in it. The problem would be if the bank as frozen your account and you cannot get access to it. I would check to see what state the account is in and if possible withdraw the money straight away.
I know hindsight is a wonderful thing, but it is essential to sort out your bank accounts before going bankrupt.
Hope your account as not been frozen yet. If it has then I would get in touch with the OR and tell them of your situation. I am sure they will understand, as I said these are essential living expenses.
I think it is the bank that freeze your account and not the OR, and he would have no interest in your wages if you need them to live on.

Hello there, I know you want a professionals opinion, so hope you dont mind me adding mine. Our accounts were never frozen. We had the same slow problem with the Co-Op, but thankfully all was okay. My thoughts were (a little different to Debtrider), that the OR freezes account, but ultimitely it is the bank that will shut them down? I agree that a call to the OR to unfreeze the account will be all it takes. If the account is not frozen then take out your dosh asap and keep a log of what you used it on, just incase the OR asks. hth xxx

Thanks guys.
How do I know if the account is actually frozen? Will I still be able to access the account online or will it not let me log in? My hope is that it is not frozen by friday then I will arrange an immediate payment directly to my parent account.
I made the call to open the coop acct over 2 weeks ago & was hoping it would be open by now, also I was trusting the advice of works accounts dept so I could arrange to get payed into another acct before the wages were processed. Just shows cant trust anyone, well except people on this forum....
Should I wait till friday when wages should clear & see if I can access the account or should I call the OR tomorrow and advise of the possible problem???
As if going BR is not stressfull enough, one thing after another!!!

I think everyone is sort of right here
the bank decides to withdraw an account facility and close the account.
the official receiver decides to caution the bank that they have an interest in th bank account ( i.e. freeze it) until they have figured out what the money is for.
Likely scenarios
no money in account or VERY little then OR not interested in declaring an interest.
Just got paid yesterday and there is £2500 in account then OR will definately Freeze account until he is sure what you need and what he can have.

What would happen if I take the wages out as soon as they clear (if I can) in the account & transfer into my coop acct for use next month for dd's, bills, rent, food, living etc? |

hi
check to see what you have put in your statement of affairs as your monthly living costs ( accomodation / food / bills etc) and I don't think you will be falling foul if you withdraw that providing the account is open.
would probably mean a trip to the bank to withdraw over the counter.
if there is surplus then would recommend you leave that in the account

Hi,
The banks froze our accounts eventhough they had a letter from the OR stating no interest. We do online banking and it showed as 'account unavailable'. I phoned A&Leicester and they said to take passport as id and gas bill etc to local branch and they would release the funds to me as they had a copy of the ORs letter.
Lloyds tsb however has kept our accounts open(br 9th Oct) even though we have large debts with them. Very Odd.

Wow tracy.... must be the longest word ever on a post...lol Try editing the post and you can delete the m's I had online banking with nationwide and it showed the money was there but I couldnt do anything with it. |
