hi there, well after speaking to melanie on your sister site she advised us to go bankrupt, my hubby has just been paid off but im not sure when to phone the court to get forms or make appointments as he has enough redundancy to last us 2 month. i do want to get it all sorted but we are going to use his money like a wage and still pay the debt while we can for 2 month, if we apply to the court now while we have this money will we be charged, he has been to the jobcentre and is is signing on as from yesterday, we owe approx 34,000 and own a home but have no equity at all on it, any help appreciated x

Hi there and welcome to our site;-)

Firstly you can do the forms online and then you can fill these in at your leisure and submit and print once your ready. These are available from:

https://www.insolvencydirect.gov.uk/isolv/


You would need to contact your local court and find out how they book there hearings for the BR, as some you can turn up others you book. Seeing as your OH will be on benefits, you may both be entitled to a reduction in the fee, which is about £150 but you again need to ask the court when you call them what you may be able to get and how you go about it.

You will be ok to use your OHs money to live on, and usually we say stop paying any creditors before BR and save that money for the fees etc.

You can also keep your home if that is your intention as you say your in neg equity and so as long as a 3rd party (if both go BR) buys the BI which would be £1 plus £211 fees, and you can continue with the mortgage then i cant see why you cant keep your home.

thanks for reply, it does help a lot, our nearest court is 60mile away so we will deff have to phone, will the 3rd party need to be there too for the house thing? or can that be done over the phone after weve delt with it all? and just to confirm we can start the ball rolling with court now even though he has redundancy lol hes only getting £1300!!

Hi the 3rd party can do it all via paper work. As long as you have someone in mind who can do that for you then that will be much better and less stressful for you also.

You can start the ball rolling when ever you feel its right for you. As you want to stay in your home, stop paying all creditors now only mortgage, any secured debts and also utilities and save that money for your fees etc.

The forms which can be done online are relatively simple, but if you need any help just shout and we will help you.

Hi

once you have the details of the particular Official Receiver's Office dealing with your case, plus the name of your examiner, get the 3rd party you have in mind to write to them quoting your name, address and bankruptcy number. They should state that they would like to buy your beneficial interest in the property and that you are also happy for them to do so.

Likewise you should inform the examiner of the 3rd party's interest. In that way when they get around to dealing with the property side of things the examiner, you and the 3rd party can complete the transfer together.

cheers great advice, id be stuck otherwise!!!! another question though!! do we need to fill in seperate forms? i started but it will only take details for one person so im making sure ive got the right one, i think only one of the debts is in joint names so how do we go about that? xx

Hi Annie

Bankruptcy is done seperately so you both have to fill out the form.

You will have to register for both of you one ibn your name one in your OHs name.

BR is not done as a couple although you can both declare at the same time etc.

Hope that helps, also the form is all there everything you will need for the court.

morning all.....well im confused!!!!!! we phoned the court and they sent us the forms up, missing 1 and only one set so i still need to print the ones off pc. anyway it says we both need to pay a deposit of £345 something close to that!!????????????? all the fees are going to take up his redundancy but then atleast we wont have the worry of the debt......also im still confused about the one debt in joint names...do i put it on both forms or just one? oh and it says we should NOT open a bank account for wages ect until after the BR which then they will freeze the accounts, i dont like the sound of that but are we legally obliged or can i set up a post office account or something to have wages and CCT CB paid into? xxx

Hi Annie

Yes the fee is £495 each but if your on certain benefits it can drop by £150 if you apply and are entitled.

The bank accounts, i did mine after but i used a friends account until BR day for DD's, my benefits were paid into a Post office card account and all taken the week before and then changed to giros or put on hold while i set up a new account. OH's wages were paid into old main account until the friday before and we withdrew the lot as his payday was about 5 days before we went BR.

This gave us enough time to start a new account after BR, and get money paid in. Some on here have opened a coop account before BR so you could apply say a week before your date and you wont have to put it on the form as you wont have the details for it, thats because they post it out and it takes 10days ish to get this to you.


The joint debt will have to be included on both SoA's otherwise the other party WILL be liable.

thanks, im starting to fill the forms in today and will phone the court tomorrow to make appointment to go down, once we have the date i will set up something for my wages xx lol i didnt expect reply so soon!! your up early for a sunday!!

yes, im doing mine now, only im stuck, on the divorce bit it asks what value did i get, it was nothing as id bought most of the stuff myself and he was happy to leave it with me but it keeps saying it has to have two decimal format?? ive tried 0.0.0 0.0 0:0:0 and it wont accept it???
