please help me! my husband owns a flat that he rented out when he moved in with me to cover his mortgage.the agent he lets it out through have not paid his rent money for the last 2 months and he has now defaulted on his mortgage.he now has no option but to go bankrupt as we simply cannot cover the mortgage.all he gets into his bank is 200 pounds a month carers allowance for looking after me. out housing benefit and child tax credit etc goes into my bank account. is it ok for him to go bankrupt on his own or will the people chase me for the money owed as we are married.the mortgage is in his sole name and he took it out years before he met me.i dont want to have to go bankrupt as my benefits pay our rent etc and day to day living and if my current account was frozen,then we wouldnt have any money to live and we have 2 children.his flat is up for sale but hasnt gone through in time and no end in site.he phoned mortgage company to explain he cant pay and now they want to know what benefits i get but all i get is incapacity and dla and child tax credit.please please can anyone help.thanks so much.

hi jo and thankyou for the welcome.the mortgage isnt in joint names and is solely in my husbands name.he took it out 4 yrs before he met me.the mortgage people have already asked today for my income details.what about this and the bankruptcy? thankyou.

Hi Ladylump

I doubt very much that you would have to go Bankrupt yourself as i cant see why the mortgage co would come after you if the mortgage is not in your name.

I would say though that you do need some one to one advice esp about the non payment from the co that you were using to rent the flat out.

That said the number is free and if they cant speak straight away, then leave a name and a number and someone will get back to you.
