Hi i am planing to go bankrupt in the new year but have a home visit from a debt company today obviously wanting to know how i intend to pay,the debt is for only £89 its one of the smallest.what i want to know is would it be worth paying them off in full to stop bailliffs before my bankruptcy,a family member has offered to pay for me as i dont want to lose any of my belongings,would the courrt need to know if it was written off by being paid in full. Thanks dont know what to do for the best i dont have alot except my computer which has all my kids photos on and if they take that then i will never get them back,please help.

Hi Saleena,
The issue you have here is that this will be deemed a preferrential payment. The OR will claim this money back and distribute it pro-rata to all your creditors. When they turn up, I would suggest you mention this and that you are going BR in the New Year.

can you tell me how the court would find out about this debt if its not listed on the form as it would then of been paid just trying to find a way to stop bailliffs coming knocking thanks for your help.x

You have a legal obligation to disclose it on your SOA (deliberately omitting information would be classed as perjury), plus your BR will be advertised in the London Gazette, Stubbs Gazette and local paper.

ok im gonna tell them the truth about me going bankrupt and see what happens spoke to family member who is debt collector and he says it would probably take atleast 6 months for bailiffs to come knocking by the time they gone to court etc so by then i would of declared bankruptcy anyway thanks for your help dont want to get into anymore trouble just trying to protect the only things i have left,thanks so much.x

Julian, would the OR really bother to reclaim £89? I would have thought that the costs involved would be too great.
Tomorrow is a mystery, yesterday is history, today is the present, a gift to make the most of.
