Hi everyone,

I haven't been here for a few weeks for various reasons but yesterday my husband and I were finally made bankrupt. We were originally supposed to do it on the 5th of December but I didn't have all the correct paperwork to claim my fee exemption so we had to rebook for the 17th. Anyway when we first got to the Court the woman checked my exemption form and took copies of all my bank statements and benefits letters. For anyone who is claiming this exemption take EVERYTHING you possibly can. I was told to take only certain documents but ended up needing other things hence the problem on the 5th. I had my fingers crossed the whole time and thankfully it was all in order. She then went over the SOA and we had to sign a few things. Next we had to go somewhere else to pay our fees and to swear our affidavits. It was all very straight forward and the people were professional. Next we were sent to another floor to wait to see the Judge. I was very nervous before we went in as I thought he might tell us off for having so much debt. I needn't have worried as he was very nice. He said that he didn't see any other way forward for us but to go bankrupt and declared it straight away. He was very nice and even pleasant when my 2 year old (who I had to bring with us) started to get kranky. We were only in there for about 5 minutes. A woman typed up the order for us, gave us our copies then we were on our way. Everyone was very nice and not once did I feel like people were looking their noses down at us. We have spoken to the OR today and she seemed pleasant enough also.

So all in all it was not such a bad experience. Thank you to everyone who has answered all my questions over the past few months. I really appreciate it and couldn't have got through yesterday without the help I have received here.

I am pleased the interview went well. They don't always (see other recent posts). Not eveyone gets to see the judge. Often, like in my case, the judge simpy checks the papers between other weighty cases whilst probably having a cup of coffee and authorises the stamp of
the form. That he saw you is a good touch and hopefully all bodes well for the future. Next stop, a letter then an examiner interview, probably by phone.

Yes it was nice that he actually saw us and was very understanding. Have spoken to the OR on the phone and am now waiting for the letter. It has been nice to get the court stuff out of the way before Xmas and even better when I have been able to tell some of my persistant creditors that I am bankrupt!

Im sure you will find telling the creditors refreshing - I didnt rub it in as such, but with the really nasty ones i didnt feel guilty for telling them. I sent a copy of the BR Order to all creditros, so the letters stopped sooner than waiting for the OR to inform them.

Hi Amanda

The day we went to court was the day i could not resist temptation and i call every single one of my creditors and gave them the good news.

It was the bestest feeling (naughty i know) but it can take the OR a few weeks to get the letters out and also for the creditors to stop the letters, calls etc, so i did it as soon as we got back from the court.

Its nearly 5 months now for me and OMG it has gone so quickly, but i still dont feel like a BANKRUPT, if that makes any sense, its not sunk in. Its great not having the nasty calls during the day or the threatening letters from them demanding payment but overall apart from the main part of the stress and worry has gone i feel no different.

I would also like to add that for those newbies looking on the site thinking what should they do, that for me and my family it was the right decsion for us and i have a life again.

You can live without credit and as long as you have your family the material things mean nothing.

Take care and do enjoy the start of your new life.
