I was declared BR in May, and moved out of my property in mid July. In mid October the house was repossessed by a secured loan company, and they have now informed me that they are to apply for a warrant for possession. I thought that was what had happened in October??!!!

Anyway, how do i stand legally in regard to the house? Am i still responsible for it?

Hi

until you are no longer the legal owner you are responsible for the mortgage, which should be written off against the sale of the property and your declaration of bankruptcy, the utilities, unless you have terminated the arrangements with the utility suppliers, amd the council tax, unless you have informed the council you no longer live there.

Hi

I have cancelled the utilities, and the council have been informed that the property has been vacant since mid July. Have also informed council of company issuing the repossession. I just don't understand the house being repossessed in October and now the same company issuing a warrant for possession, seems to me this is the same thing??!!

Hi

once a repossession order has been granted by the court you have a mandatory 28 days to pay the arrears even if you have stated that you do not wish to do so.
After this period the lender must apply for an eviction order which can take a few weeks.
Then you get the notice for actual repossession and or eviction.

So don't worry, it's quite normal.

What happens if the property gets damaged in some way, such as a broken window?

Who is responsible for repair?

Hi

that's a mute point but technically until you are no longer the legal owner then you would be responsible.
That said, I doubt the lender would bother chasing someone in bankruptcy for a window.

Any very costly damage may be a different matter.
