My partner was made bankrupt by court February 2008. We have joint mortgage which he has never contributed to, I always have solely. We have a son of 16 who is still in full time education. My solicitor advised me that on 12th Jan 2009, the Official Receiver is going to court to force sale, I have tried to raise funds to buy him out, but am failing miserably due to bad credit rating, can I do anything to save my home for my son and my own sanity. PLEASE HELP ME OR ADVISE?? |

Hi Diane
from the summary information you have provided it could be that you have a case for defending the application for a forced sale but an argueable case needs to be put together and quickly.
If you're not sure how to defend yourself, or even if you actually do have a defence, you need to speak to a professional as a matter of urgency.
That said, it's Christmas Day (just) as I write and business is closed down for most people.

I would really recommend you call John as soon as possible to discuss.
You need to get help QUICKLY and depending upon house prices and mortgage the situation regarding equity may well have changed considerably since january.

Hi John, Many thanks u's for your reply on xmas eve, hope you had a nice one, we tried hard and managed Xmas Day, but then you waken up next day and the real world is still there. All I seem to be thinking is only 16 days left till my world falls apart. I have lived in our home for nearly 20 years and we had our son here. My partner has always been dis-responsible, but because he is my son's Dad we have tried to keep things together, but now falling apart. I am in Aberdeen, Scotland and I will try everything to contact you tomorrow (Monday 29th). Once again thannks for replying. Do I call on the mobile number, it's just I often don't have credit, but I have a house phone, just trying to find a good time as my partner is always around at home, as again he's not working!!! Have you seen a solicitor ABOUT IT & if so what did they say? Has your partner always lived in the property with you & have they contributed in other ways to the household income? |

HAVING FIRST READ YOUR MESSAGE OF YESTERDAY ONLY THIS MORNING - I REGRET TO INFORM YOU THAT I AM NOT ABLE TO ADVISE YOU ON THE MATTER OF THE MATRIMOMIAL HOME, AS PROPERTY IN BANKRUPTCY IS DEALT WITH DIFFERENTLY IN BANKRUPTCY NORTH OF THE BORDER AND I'M AFRAID I HAVE NO EXPERTISE FROM WHICH TO OFFER THE NECESSARY ADVICE.
CAN ANYONE ELSE ON THE FORUM HELP WITH DIANE'S PREDICAMENT?
