Hi, I am putting together my letter for "comprehensive details of why my vehicle should be exempt from the bankruptcy estate" I have put this:
Thank you for your letter of 30 December 2008, I reply as follows the reasons I feel my vehicle should be exempt from the bankruptcy estate:
- On my return to work in March from Maternity Leave I need my vehicle to get to work. My place of work is 27 miles from my home address and is accessed fully by motorway. - My two young children aged 3 years and 6 months will be attending full time nursery which is 8 miles from home address and I need the vehicle to take them to and pick them up from the nursery. I also need to be able to collect them from nursery should they fall ill and get to them as quickly as possible. - My eldest child has a rare kidney disease, Nephrotic Syndrome and is under consultant care of Guys hospital and seen at Maidstone. He is seen regularly for check ups by the consultant at Maidstone hospital and I need the vehicle in order to take him for his appointments. Upon a relapse, which in this type of disease is inevitable, then I need to be able to get him to the hospital quickly in order to receive the necessary treatment and my vehicle will be necessary for this. - I have no relatives of friends close by to assist in any of the above instances as they are all a minimum of 33 miles away and will take about 45 minutes to get to me so a vehicle is very important.
Is this ok? Should I add any more go into more detail? It says Comprehensive details of why but is too much seen as waffling? I just though I would bullet point the reasons and keep the reasons to the point and not go off into other reasons etc. Also will it be acceptable to email the letter and send in the post? Just to make sure they get it or should I just post?

I think your letter is fine, if you can send off a copy of an appt for your son that may be good and then the OR will see that you have more than enough evidence and need to keep the vehicle.
Let us know how it all goes, oh and you could email and post the letter of to them:-)

thanks Jo, do I need to go into more detail, i am wary of the "comprehensive detauis" bit in the letter for why. Also should i mention value, I brought for 2.5k in Nov and looking on auto trader same car is about £1800 |

Hi
I would not mention about the value or when you bought it, as i dont think they will be looking at that part, they need to clarify why you feel you need the car in the first place.
I would not add in anymore information i think you have put in plenty, they dont need an essay just the facts so they can make up there own minds, i do think that a copy of one or 2 of your little ones hospital appts may help too.
I do hope that it all goes well for you, fingers crossed and all that ;-)

Thanks Jo, I have his next appointment card here for 23/1 which I can scan, thing is the give me a new card everytime we go so it does not show, some are letters sent with appointments and in the early days when he was discharged we went back every week for a month to the actual ward - he needs a close blood pressure check due to high dose steroids.
The end of the day I am not making it up so if I need more proof I can get all the consultants letters from the consultant he has sent giving full details of his condition etc.
Anyway waffling here so shall I scan the appointment card for his 23/1 appt and attach to the letter? |

All I stated with my car was that I needed it to commute to and from work (84 mile round trip each day via the motorway), that I worked shifts and was unable to use public transport as my shift hours didn't always fit in with trains/buses.
The OR didn't want to know any of the other reasons - the "needs for commuting to work" box was ticked and that was it.
Your letter is fine and has so many extra reasons I can't see anyone arguing with it.
(My OH went BR at the same time as I did - he isn't allowed to keep his car with transporting children to/from nursery as a reason or for getting to his hospital appointments as he is supposed to be able to use public transport - however he is allowed to keep it as far as looking for work goes. If needed we will also point out that he has a medical problem which reduces his ability to walk long distances so can't really cope with buses etc but we haven't had to mention that yet). |

Hi help007,
My car was exempt (valued at £2500). I explained that I needed it for work and for tranferring my children (aged 1 and 3) to their childcare.
Who is dealing with your estate? Is it Medway at Chatham Dockyard?

Hello Help 007,
This all looks like it will work out very well.
Firstly, from my own experience, the Offcicial Receiver's office has guideline which say that a vehicle below the value of £2500 should be exempt. Your car appears to fit in to those guidelines. Mine did, also, and mine was declared exempt. I did not submit a letter but declared the car in my petition and its value. In my telephone interview the examiner went through the petition line by line, as they do, and got round to the car. He did not, in my case, seem unduly concerned whether I really needed it, which I did, but was most concerened, probably, after the interview, to check the probably value before sending me aletter a week or two later which delcared the car 'exempt' from the bankruptcy.
May I say I am sorry to read of your circumstances and wish you and your family all the best. I will be amazed if your own vehicle is not declared exempt PROVIDED the value is correct.
