I have been taking advice from your site as I am defaulting on a IVA. My situation has changed i.e I have retired from work at 60, some ill health involved. I have had the IVA for 30 months. I stopped paying three months ago and have kept the money saved to declare BR. I told the IVA company what I was going to do before I defaulted. and have had letters from them about my none payments. I have replied to them all with my original letter and a covering letter (3 times ). They have asked me to phone them. I have asked for all corespondence in writing. I do not wish to phone them because I was lied to on the phone by them 3 times when I took out the IVA. I would never have accepted the IVA had they been truethful to me. They have said in writing that they would consult my creditors to see if they want to declare me bankrupt. I was expecting this so no problem. Now I have a state pension as only income. I have no savings. I do not own a car, I have never owned a house. I live in a housing association property and my rent together with council tax will be paid by my local authority. The IVA company have phoned me but I have not answered, I am scared to. Am I ok asking for everything in writing as it gives me time to absorb it and time to prepare a reply. Thank you, Carol |

Hi Carol,
You have nothing to lose by going BR. You have every right to insit all contact is in writing, so don't worry.

Is it better to wait and see if one of my creditors declares me bankrupt. or is it advisable to go ahead and do it myself. I have heard that they may not bother. Thank you so much for your advice. Carol |

Hi Carol,
As it will cost a creditor about £2k to take you BR, they will only do it if they are reasonably certain they will get something out of it. I always advise that it's best to do it yourself as then the BR is on your terms, not your creditors'.

Hi Carol
I agree with Julian here if bankruptcy is what you want then so that you can get that fresh start i would do it yourself as you may wait a very long time for a creditor to do it, plus you do it when you want and can get things organised, its much more dignified i think.
