I have a cashcard accout with Nationwide. I have checked with them and they have said that they will not close the account when I declare bankruptcy but I understand that the OR will freeze the account. Does anyone know how long that will be for as I will have direct debits (utilities) to come out shortly afterwards and don't want to incur bank charges. Should I leave enough in there to cover them or will the OR take the money? I have tried to set up a Co op Cashminder account but they advised leaving it until after I declare as that will be frozen as well.

As I am quite behind on this years Council tax payments, can that be included in the bankruptcy as well?

Hi Brokebutstillalive,

It is not the OR that freezes the account, it is the bank. Standard banking paractice would be for the bank to freeze the account (on publication of your BR in the London Gazette and the Stubbs Gazette) until they hear from the OR. However, if it is just a basic bank account and you have no borrowing with that bank, the OR wouldn't have an interest (unless you just happened to have several thousand pounds in there).

If you are still at the same property, local authorities usually re-schedule arrears in order to avoid having it written off. Therefore, it is likely your council tax payments will go up until the arrears are cleared.

Hi Brokebutstillalive,

I work for a local council and although some councils may try re-scheduling your payments, you are more than entitled to add that debt to your bancruptcy and the local council will write off any debts upto the date of bancruptcy and send you an amended account from the date of bancruptcy onwards up to the end of the financial year .

Well worth doing !!

Thanks all. There most definitely will not be several thousand pounds in the account so should be OK!!
