Please help
Me and my husband are both considering bankrupsy.Around 4 years ago i started getting into debt, at the time both me and my husband were working full time, and we could afford to pay our debts. Unfortunatley i gave up my permement jub to work for an employment agency,it was better money and they promised me it would be permenent!! typically i was layed off 3 months later! A few moths after that i got caught pregnant, unfortunatley my little boy was born severley disabled, and i had to become his full time carer. I contacted my insurance companies as i had insurance on everything (inclunding insurance on events of becoming a carer) and none of them paid out, as i wasnt in permenent employment. Since then I have just had my home repossessed, luckly i have got a house from my local council that i rent. I am in about £30,000 unsecured debt, and i am quite sure there will be a shortfall on my old house of around £25,000. our income get swallowed by our general living expences, however, my little boy is in receipt of disability living allowance, and motability allowance, i am wanting to know, do the court take this money into account? Allthough this money gets paid into my account, it is not mine, it is solely his for his disability. I have contacted several different places, some have told me they do take it into account, and other have told me they dont. Also the last loan i took out was in september of last year, it was to settle an old car loan and i borrowed an extra £1000, even though i was already in financial difficulty when i took out this loan, at the time i wasnt considering bankrupsy, we only considered it since we found out there was going to be a shortfall on our old property, and also we took it out because it was a case of "needs must" we had just moved into an unfurnished property, with no money what so ever, as my little boy still cannot walk, I had to have carpets, but what will the courts say to that, do i risk prosecution?

so sorry to hear you have been having such a tough time, you have come to the right place for support and advice though !
with regards the DLA, you must list it as an income but NO payment order can be attatched to that, i only know that as i too have a disabled child and that was one of my questions, one of the more experienced members will be along soon to hopefully help you out further ;-)

nikki, some people are able to get free help from their local citizens advice, but quite a few of us on here have done the forms on our own, and then posted on here any questions they are struggling with, and everyone here is a great help :-)

Hi

the site is a great place to get question by question help from people who have gone through the same process. There are also some experts who can help with more technical questions.

The CAB can help with forms but I understand they are limited to around 4 house of help per person. If you call the helpline they can put you in touch wih companies who can do all of the forms for you but would obviously charge for their time.
