I'm about 3 weeks into the 8 week wait for ED. So far, no mention of an IPA, has anyone had their OR call for one at the last minute?

This waiting game is like the days waiting to go BR. Sent my updated I&E off registered post, now keep panicking that they didnt recieve it as dopey woman in the post office could not find address on system, then she suddenly put it through, but I cant find my reciept!!!!!Arrrgggghhhhhhh!

yes, we did! The OR tried for an IPA at the beginning of the bankruptcy but we argued that we did not have enough surplus. We did not hear anything from them for a while and then we got an I&E form to fill in for ED and the OR tried AGAIN 5 months after bankruptcy for the IPA

We had to send a load of receipts and such in to prove our outgoings and they dropped it in the end but it delayed hubby's ED by one month.

The IP Questionnaire one received at around 5 - 6 months is so that the OR can review your situation, dependents and I/E. This is so they can review the possibility of starting an IPA.

Please remember though one has the responsibility of informing the OR of any material change in circumstance throughout the term.

I sent exactly the same I&E in at the 5 month stage as I did at the start of the bankruptcy as there had been no change in circumstances or pay rise

I think they were just "trying it on" to see if we would agree to one, when I questioned it, they had not put down household insurance, dental and optician costs!!!

The receipts they wanted were proofs of living costs, eg.cat food/litter, petrol, gas/electric bills. council tax bill, water meter bills, phone bill etc.

bearing in mind there are 2 adults and 3 teenagers and only hubby was working, we had £20 surplus left, so we really could not see where they wanted to take £50 per month from, they seemed to be saying that our surplus was £100

Glad to say, they saw sense in the end

The I&E that I sent back was different to the one first submitted as my mortgage dropped by £175, however I also became a single lady with tax credits to top up my wage. It balanced out to be the same, but no news yet. I honestly would not be able to afford an IPA.

As they say no news is good news, so i would not worry and just get on with your life.

We are still waiting for our OR to get the last of our info to them then maybe we may hear about an ED, but to be honest i am not bothered, just want to sort out the house now.

Trolly,

You could just ring the OR to make sure they received your IPOQ form (I did) but don't ask them when you are going to be discharged.

It is quite important to check they got it and fully justifiable as there are repercussions if they don't receive it back from you. If its 3 weeks now I would check with them asap. They won't mind you checking.

Provided the information you put down was about the same as your original I&E information you should not suddenly get an IPA. Also, provided no creditors object, your early discharge could happen about 6 or 7 weeks after submitting the form.

Trolly,

Sorry, I missed that your circumstances did change a bit. Other than making sure they got the form you'll have to just sit tight. Yes, your mortgage went down (is it interest only? if not, you could legitimately turn it into a repayment mortgage) but bills are going up.

Please do check the Insolvency Service links for Household Expenditure so that if the proverbial does hit the proverbial you can make sure you are claiming all you can claim. Remember, as Jane.l says, you don't have to agree to an IPA even if they suggest one. You can argue your corner. Though, they can press for an IPO if they reckon they could get one.

Thanks for the tips Pix. I have now found my reciept/proof of posting, so will follow that up asap. The guidelines say that me and my 2 children should live on £281 pm, but I just cant manage on that. I'm not in the least bit excessive anymore but I do spend a min of £100pw on food, cleaning and household items. Yes I'll have to fight against an IPA!

That does not sound a lot esp when you happy nappies etc etc to buy.

I dont know what planet they were on when they did the allowances but i think in this day and age they need updating and even moreso now.

Hey TD....It does sound like they are going to check every detail before you get ED - Im crossing my fingers that i get it

I think with the economy how it is they should be in the process of updating the I&E allowances



Onwards and Upwards is the way im going :-0)

From "Moneyworries" to "Movin On" in 3 months is fantastic :-))
