Hi, First of all as a newbie I want to say Thank You. Reading your experiences has made me feel that I'm not totally alone any more.

At the moment I am on the very first step of the ladder, I haven't even filled in the forms!

I have a credit card debt of £30k. I've done a lot of stupid spending, robbing Peter to pay Paul, bailing out my family via credit!! and then becoming adicted to tarot "helplines". (I was looking for reassurance that never came)

Anyway to get back to the point, although there is this debt, and the fact that due to health and other issues I am currently unemployed I have been late but never missed a payment. All my bills are virtually up to date. (just increasing through interest and charges etc).

I have been to CAB and CCCS and every other free financial advisor and been told to declare BR. My debt is not fixable.
If I miss payments I can have the fees to file in a few weeks. Is this the right road to take? or should I carry on paying and file sometime in the future?

I know I'm rambling, I'm so sorry. I just don't know what to do.

Hi Leah and welcome to the forum.

You are not the first to rob peter to pay paul, so dont give yourself a hard time about it.

You have sought advice and been advised that br is the best route to take.

Once you have decided you can stop paying your unsecured creditors (you will need to continue to pay secured borrowings) to save for the fee, which is £495.

I would go to the insolvency website which is http://www.insolvency.gov.uk/ and there you can either download the form or start to fill in online (which is what alot of us have done)

You will need to contact your local county court to see if you can 'turn up and declare br' or if you need to make an appointment, some of them have a waiting list of a few weeks.

Do you have any assets (i.e. car house any valuables)?

Thanks Jenny, Its so great that everyone here supports each other.

Does anyone know - I've been trying so hard for so long to manage to make at least minimum (if not more) payments that I've let basic things like home insurance, glasses and even any kind of social life for the kids go by the wayside. Will the OR let me add anything like this to my necessary expenses even though I am not making any payments for such at present?

Hi leah

the addiction to tarrot lines, has this now ceased, if not, the official receiver may not look onto your case plausibly, If it has ceased then its upto whether to mention it on your reasons for Bankruptcy, if it hasnt ceased then you would need to mention it, and the active steps you have took to try and overcome it, such as self help, help groups etc, maybe a letter from the GP etc.

Take a look at this link its off needafriends blog, it says what are allowable expenses. If there are other things you need to account for then just list them on here and you will get a good idea if it will be allowed or not.
