1 I have a car loan with ( un) welcome finance for 5000 2 I have personal loans with ( un )welcome finance for 3000
I have just moved and ignored these debts I think I have ccjs for the ( not 100%) when I signed for these loans I needed to put on the forms two people that knew me and get them to sign the application . I filled in two people that did know me and signed there names instead of getting them to do that ( they are not guarrentees ) just if I default a way of tracking me down .
Q 1 is this fraud . q 2 if so will I be able to include this if I file for bankrupsy
It has been nearly 6 years since I made a payment but I think they have a ccj on my previous address
Also a while back I filled in a tax return and had a rebate , I was then investigated and had to repay the money ( which I HAVENT DONE )
Q CAN THIS BE INCLUDED IN A BANKRUPSY
Also I have done a few runners fron flatts in the last 6 years one I left in a bit of a mess where my rabbit had eaten the walls and carpet .
If I go bankrupt can these debts be included in bankruptsy
Also last year I had a tax rebate of 2500 it was for claiming lodge while working away , I wasnt actually lodging I was sleeping in my van , I filled in receipts myself for fictisious bed and breakfasts
If I am investigated can this be included in bankrupsy
Also credit cards maxed out never paid 3 overdraugts in 3 seperate banks 1500 each ( statue barred now ) 10 years ago
council tax I owe 1000 plus same can this be included
If I owe money due to fraud I think about 1500 pounds can this be included
all together about 20000
I have a history of getting into debt and not paying it back can this be consituted as fraud ( I have made some repayments but then seem to get into difficulty )
1. Falsifying an application for credit is technically obtaining money by deception which IS fraud. 2. As long as the fraud is not uncovered, this debt can be written off in BR. Please bear in mind that you have to swear an affadavit when presenting your SOA to the court, so knowlingly omitting information or providing misinformation is perjury which is a criminal offence. 3. Debts owed to HMRC can be included and written off in BR.
ALL unsecured debts except student loans and court fines can be included and written off in BR.
I think you will need to tread carefully as you are looking at least at a BRO/BRU. I think a fraud conviction would be unlikely, but not impossible.
