My partner told me he was going to be made bankrupt in november and that it was goin to happen in jan or feb.hes not going to go to court. high court in london.then finished the relashionship in jan.when things had been goin good.ive also noticed his mobile phone is always turned off and only uses the contract one his brother gave him for work as he workes for his brother.if he told me this in november and i asked him if he had the letter rom courts yet he said he hadnt. how long does it take when there making him bankrupt?? he hasnt told many people only me and his brother. but says hes not bothered. do you think he is and thats why he finished the relashionship. |

Well if he has the appt in Jan/Feb it would be made same day i believe so you could check on the insolvency register and see if he has been added on there or not yet.
As for him not answering his phone then i cant help you, he must have his reasons and some people find it easier to shut themselves away. Whilst its hard and you want to help him he must be finding his own way to deal with that right now, if you do speak to him make sure he knows he is not alone and that you are there for him.

He told me in november. i just need to know how long it all takes to go through. hes not goin to court.but how long does it take and when should they be informing him

If he had been written too then he would have been given a date for the hearing. I would imagine that he would be declared BR in his absence if he does not intend to go, so the letters that would have been sent would give him the date.
Bankruptcy is declared same day, and the register updated within a couple of days. He may have already been made BR.

i keep asking him he says hes still not heard anything yet!! he is an honest person with me i hope.just needed to know how long these things take altogether from start when it goes from recievers to then to other people then finally to court.if i was told in november.can it take months to all go through when he was told that would be what they were going to do with him.

To get to court if petitioned by a creditor maybe 3-4 months, then he will be bankrupt for 12 months, maybe less if they are happy and the file closes sooner.
It could be more ONLY if someone does not cooperate or there are things that make the OR think differently, but most people are discharged within the year.
Here is a link to the insolvency sites register, on here you can check names etc and see if your Ex has already been declared BR by a creditor.

Yes thanks it did help as i wanted to know how long it takes. he said he hasnt got letter yet. but owes over 50grand so i think he might be bankrupt for a lot longer than that. and hes not goin to court. he says hes not bothered but deep down i think he is. hes only told me and his brother so that says somthin.

We petitioned for our own bankruptcy, thats myself and my oh and we owed about 65k, we are 6 months in and so have 6 months to go, there would have to be exceptional circumstances for the OR to make a person have a delayed discharge, so they would be dishcarged in the 12 months.
Best of luck and tell him not to worry, he is not alone.

The amount of debt does not relate to the length of the bankruptcy period, everyone is discharged after 12 months unless they are not co-operating with the OR and then he could suspend the discharge.
We owed about £100,000 at the time of bankruptcy (this would be more now as our house sold at such a great loss) and we were discharged early, me at 5 months and hubby at 6 months |
