Hi there all,

Just wanted to let you know that as of today we are officially bankrupt!

Myself and my partner were in court at 9am this morning and were there for about 2 hours all in all.

It was not bad at all, in fact the most difficult part was driving into town through the snow with a 2 year old in tow! Thankfully the one that is due tomorrow decided to stay where it is for now, too cold outside!!

We sat down with the BR Clerk first and went through the paperwork, he said he would arrange for the judge to see us, however after 15 mins waiting we were told that the judge didnt want to see us (fine)! We went through to a meeting room and had a telephone conversation with a clerk at the insolvency service, she just confirmed some details with us and said that an OR would be appointed and would contact us within 10 days or so to arrange our interviws.

We came home and rang the cooperative bank and opened a joint account and will receive the cards etc within the next 10 days.

All in all I have been very surprised at how nice everybody has been to us since being made bankrupt!

My partner had a few grand of student loans outstanding which we put down in our statement of affairs as outgoings, we know that these cannot be included in the bankruptcy however, we just wasnt sure whether these are put on hold until discharge from BR or until after an IPA (should one be made) or would these be considered as outgoings when the OR is considering an IPA (if you know what I mean)?!

I just wanted to say thank you to all who have gave us advice and support whilst going through all this, it has been greatly appreciated!

Hi,

I'd be very interested in the answers to your questions about student loans. I went BR on 21st Jan and put them down in the secured section as was aware no student loans could now be included in BR, I also put the payment in my outgoings as assumed I could carry on paying as soon as I've spoken to the OR on Weds 9.30am (wish me luck!!). I'm only two months in arrears so wanted to bring up to date asap.

Glad it all went OK for you today.
