if we got help off a solicitor, would he give us time to pay for the fees just knowing we will have to pay this isnt helping making the choice any easier, or finding the money for that matter.

No they would want fees upfront, as it would be a bankruptcy offece to allow you to have credit above £500 !

thanx! getting back to adivce off CAB, if they suggest we do file for bankruptcy what happens from there, do they get in touch with someone who can help us and who we have to pay or are they holding our hands all the way?
sorry for all the questions but we dont know who or where to turn too for help with the proper channels.

Not sure if the CAB will put you in touch with someone who can hold your hand.

If you decide to go bankrupt it is not as hard as you think to make the petition.

You complete the forms, which you can do online on www.insolvency.gov.uk then ring your local county court to make a date to speak with the bankrupty clerk / judge.

You turn up to cour with the relevant fee (£485) and the clerk will check over the documents.

You will then normally speak to a judge (on a one to one basis) who will make the bankruptcy order.

You will then be passed over to an Official receiver, who will look after your estate, normally the first interview is done over the phone, either on the day of the hearing or a few days later.

He or she then has control of assets, if you have rights occupation (married or have children) then you have twelve months to vacate the property if they intending to sell the property - how much equity is in your property ?

Hi Gav

you may be able to get help from CAB but don't know what they offer locally to you.

The things you will need to think about are :-

1. Do you want to keep the house
2. If not where will you live and how to get deposit for new rental
3. need to get fees for court ( 485 each )
4. when to file for Br
5. Fill in form and carefully review your income & expenditure to ensure that you have all your bases covered.
6. Check to see how many copies of documents the court need ( some need 1 set while some need 3 sets)
7. check to see if you will see a judge & procedures for the court. Some courts accept documents on 1 day and want you to return in a week to see judge. Others you do il all on the day.
8. Understand what will happen with the OR on telephone or in person
9. Bank accounts - need to ensure you have the right one and it won't be closed because of br
10. effect on job
11. implications of NT tax code etc
12.6 months I&E review
13. Possibility of early discharge
14. Understanding of do's and don'ts in Br

A solicitor will likely charge 150plus per hour and if they fill in the forms, attend court etc etc etc it will be v expensive.

there are a couple of experts on the forum ( inc me) that offer specialist handholding services and can offer you a free face to face meting even though you are in the NE.

May I make a suggestion that you cantact paul via his website.

Although it seems you can't afford to pay fees for bankruptcy at the moment I think you will be suprised at how affordable it can be.
