i am so much in debt,in 1997 my husband passed away and i had 2 children to bring up my daughter was disabed i applied for a credit card but was on benifits at the time,over 10 years my debts amounted to 11.500 i had always kept up payments as my daughter was additional card holder and i was her career so i did not work so her benifits payed the monthly amounts.

My daughter passed away from her illness in september 2007 and i have no means of paying i have informed the credit card company and made payments of a 1.00 but are constandly phoning i am not coping and have spoken to cccs i was advised to go bankrupt and start fresh losing my husband and daughter has just tipped me over and now on anti deppressants just feel worthless and dont know what to do

Hi Jerrylee

Sorry to hear of your loss

You have tried everything and done the right things - however as cccs have advised bankruptcy could provide the fresh financial start for you.

Things to consider are do you have any assets and are you a home owner if not then bankruptcy is probably the right route.

There are a number of experts who will provide free advice

Hi Jerrylee,

A sad story and my heart goes out to you.

Bankruptcy is ideal for you situation and will stop the harassment from your creditors and give you a fresh start, but as Alan says we need to know if you have any assetts of value that could be effected in your declaring yourself Bankrupt?

You need to be aware that there is a fee of £485 payble to the court in cash on the day you declare yourself bankrupt if you are on benefits this can be discounted by £150 so keep this in mind.

Hello Jerrylee and welcome to the forum

Dreadfully sorry to hear of the difficult time you have had.

As Alan said you haven't done anything wrong and indeed you have tried to pay something toward the creditors each month. In reality they will probably chase you for a long time and the last thing you need is the stress and aggravation of the eventual county court summons and bailif visit.

It would be good to know a little more about the situation but if you are renting and have no assetts then bankruptcy would be a finanl conclusion to the debt.

i do not have any assets, i do not own my home, debt has occured over the years just to survive because of my situation and been on benifits i just could not provide for my daughter which the only way out was a credit card i was a young widow of 35 and trying to give my daughter a discent life, my daughter passed away aged 24 but knowing she was given everything and had a happy life helps me alot but now the guilt has set in, on the state benifit and owning credit cards this was never my intension i thought i would just get into work and pay my debts but had a set back each has delayed thisbut many thanks for you infor

Hi Jerrylee

if you are receiving benefirs then you would probably qualify for a reduction n Br fees. These would be reduced from 485 to 335.
