Hi

I have my court hearing on Thursday 26th Feb 09 10am

This is actually the second time I have had to go through Bankruptcy. My last one was ten years ago in 1999.
Does anyone know if this will affect my hearing?

2nd time bankruptcy is never a good thing.
The first time around is to give each of us a 2nd chance. Doing so again is not usually well received.

However in your case it is 10 years since the first time. Normally you would only expect to be questioned over the next time if it were within 5 years. Additionally there are hundreds up and down the country declaring themselves bankrupt each and every day right now. The present crisis has caught very many that otherwise would have been able to battle through.

So on balance I think you have very little, if anything at all, to worry about.

My hubby will have to go thru BR for a 2nd time in 12 years last time being 1997. i spoke to my OR about this situation as it will be due to a large shortfall, she was of the opinion that it is in his case a totally different scenerio so not to worry, ie, first time was business/tax related and he was made BR and this time it is personal and he will be declaring BR himself.
