 I was made bankrupt on the 11th November 2008.

I was made bankrupt on the 11th November 2008. However, one of my larger creditors has put a charging order against my property after this date...December 2008. They are still sending me letters for a payment plan and now they are now sending me letters threatening me that they will have to sell the property to recoup their money.

I did inform the liquidators at the time in December but i feel they have not done anything about it.

1. Can the creditor put a charging order after the bankruptcy date?

2. Can i get the charging order removed?

3. How?

Hi alkesh

Any charge put on the property after the date of the bankruptcy order is void and can be removed by the Trustee/OR. If you are going to keep your property and buy back the beneficial interest, once this is done you can send a copy of your bankruptcy order to the Land Registry asking them to remove the charge as void and also send a copy to the creditor informing them of what you have done.
