I have a car. It is being paid for by my Mobility allowance of the disability living alowance I receive for "Help with getting around" and is on 4 years hire purchase.
As it is being paid for out of money set aside for that purpose am I safe with keeping it as it does not actually belong to me for another 40 months or so?
As an aside, the insurance says it has to be parked in a garage overnight. I rent one from the council. Can I list that in my expenditure?
Is there a list anywhere of what I can and can't claim.

to add to that last line...
Is there a guide as to what is an acceptable amount of money to live on and what I can list as expenses?

Hi there

You should present your income and expenditure as it is actually received and incurred and not worry too much about allowable levels. The OR will advise you if they feel that anything is too high, and you will then have the opportunity to appeal if you feel they have been too harsh.

With regard to your car and garage, these costs are unlikely to be affected under bankruptcy proceedings, but do check the fine print of your Motability agreement to see if this terminates on the making of a bankruptcy order against you.

Hi Pedaldog,

As Melanie has said check the contract first to see if Bankruptcy will affect this in any way.

Have a look through the two links below, they explain all about income payment orders and agreements and what the OR accepts within the expenditure, however as Melanie says there is no set level, it is just a reminder for things to include.

Thanks for the help and pointers to the links. It has eased my mind a little now.
Looks like I'll lose the internet and that is the only contact I have with people other than my carers. Oh well!

Hi Pedaldog,

You will not necessarily loose your internet as you are allowed a certain amount of disposable income before they will look at an income payment order, and your internet payments could easily come from this so don't worry to much.

There is no way that the OR will disallow you the use of the internet. Have you read something which might suggest this to be the case?

many OR's would only consider internet access as essential if it was for work related (income generation)or for educational purposes ( if there are dependent children then approval is a given) Otherwise it could be considered an expenditure of choice.

If however it was part of a telephone bundle and not specfically mentioned then not usually enquired on.

Although the internet is not a specific requirement for you to live as Julian says you are allowed a certain level of disposable income so you will be able to keep your internet.
