Hi, I'm about to go bankrupt, but have a query. my debt is with several visa's. = £30,000 but one of them £18,000 was signed by me and my wife. when I go bankrupt will she be asked to pay for this sum, even though our finances will not be able to pay for this even as a combined earnings? Will it be part of my bankruptcy? One last question please, my wife has a plot of land but is not going bankrupt can the they use this when i go bankrupt as an asset, the land is soley in her name. once again many thanks for any help.
If just you are filing for bankrupty - only your debts are included (and assets) with regard to the credit card debt, it depends on who is the original card holder - if you are the original card holder and you wife has a card on your account you are liable for the debt - If your wife is the original card holder and you have a card on the account - your wife is liable for the debt, you need to check who is the actual account holder.
