Hi guys, I really desperatley need to know whether I have to continue paying my mortgage if I am filing for banruptcy on the 16th April? If i do, will the OR view this as preferrential payment? I am currently in arrears and have managed to maintain payments for the last two months and lender has agreed to capitalise the remaining balance of arrears, but that is only subject to me making monthly payment today..... this payment is for the month of March, have agreed with lender to pay today and they okayed it..... Property is negative equity, and I intend on buying BI from OR if offered.... also my income was inflated to obtain the mortgage and this resulted in an FSA investigation approximately 3 years ago, which I voluntarily complied with, I assumed my property would be taken from me as a result but it was'nt and it has been three years now not a peep from lender....... any advice would be much appreciated.... yes, if you are going to keep the house and buy the BI in bankruptcy, you must continue to pay your mortgage, I dont think secured lending is seen as preferential |

just to confirm payments made in respect of secured borrowings are not deemed preferential.
