Me and other half finally petitioned for bankruptcy today! It was nowhere near as bad as I thought it would be at all. If it helps anyone else here is what happened -
We got to court with our paperwork, which the clerk went through with us and altered anything that needed doing ( we filled forms out on line) then we made an affirmation to say everything was true to best of our knowledge, then we paid the fee, after that we went to wait until judge could see us between hearings. I was hoping that we wouldn't have to see the judge, but he was fine! Just an old man in a very messy office to be honest!! He just advised us of what the OR would expect and asked if there was no hope of resurrecting our failed IVA (the answer, no!) then he signed the paperwork and off we went! The clerk then sent us to the OR's office where they took their copy and told us OR would call in next 1-2 weeks. We also had to take our 4 year old who was with us the whole time and they didn't mind us taking him into the Judge's chamber either! So nothing to be worried about and now it is done!

Congrats!! it feels good doesn't it? I had mine on Monday - already got my OR appointment on the 6th April! will be spending the weekend digging out statements etc!

Congratulations - and so glad to hear it was not as bad as you feared (it never is! but people don't believe that!) here's wishing both you and you and your other half a debt free future which together as a family you can now begin to enjoy

Good to hear everything went okay for you. I agree the court is no where near as daunting as I thought it would be and everyone was very nice (I even got complemented on my neat handwriting..lol). Even the OR has been painless...so far. I had the phone interview (i think) and all seemed to go well. I even got to keep my car, even though I don't need it for work and am in the process of agreeing my IPO, which is likely to take effect from May, all being well.

All in all, I wish I had done this years ago and although I did do a lot of research before deciding to go bankrupt, I would advise anyone who is having difficulties to take advice and see if bankruptcy is the right route for you. It was for me and now I can start to look forward to a new future.
