Hi, I have been out of work for the past month with back pains that have gradualy been getting wors (over the priod of about 10-12yrs), my doctor has put me on temporary incapacity benefit until it gets better.

My problem is I can not afford to pay my debts or live on the £56 per week.

I am going to loose my car (on HP agreement) because the guy that sold me it told me (my girlfriend whitnessed) that I would be getting payment protection but did not. Also as I can work all over the UK, I would like to keep the car as it is a descent car (valued £5000) and I will be using it to get to work (nation wide).

The thing is that I do not know when I will be returning to work it could be a month or a year, I constantly have back ach that gives way to severe pain when I lift anything or streatch.

I would like to know more about bankrupcy and would I be entitled to apply for it.

Hi there and welcome to the forum

It would be helpful to understand a little more about your situation before we suggest Br as the right solution.

perhaps you could list your creditors and how much you owe. Also have you done a full income & expenditure calculation so you really know what your financial position is without the debt payments? If necessary I can email you a spreadsheet so you can capture these easily.

Finally what job do you do ?

Approx figures off the top of my head are:

Income £56 per week, incapacity benefit.

House hold:

Electrcity: £1500
Gas: £300

Personal:
Car HP Agreement: £9000
Lloyds TSB: £500 (continuing disagreement as I closed the account before the debt occured)
HSBC: £800 (Student account from years ago)
Yell: £512
HS Student loans: £3000
Rent: £800

I will have to sort through the paperwork and draw up a spread sheet for you.

My Car is a Volvo S40 Sport (Saloon) required for high millage. HP with Welcome Finance, I rang them as soon as I came out of work and they are aware that I can not meet the payments, also they have rang and left a message today.

My Job is Electrician currently under the (CIS scheme) Inland revenue construction industry scheme.

If you give me a couple of days I will get the correct figures for the above.
