I have a 60 year old sister that's had a stroke unable to do anything her self, she cannot pay £18000 depts, she lives with me her brother she has no property to sell. can I apply for bankruptcy on her behalf. will I have to take her to the court. the debts are credit cards and loans.
If your sister is incapacitated and unable to go out or represent herself then I understand that you would need a lasting power of attorney to be able to act on her behalf.
I have seen these advertised on google for downloads but I would strongly suggest you speak to a solicitor to see how much they would charge you to prepare one for you.

A power of attorney document is a relatively simple document to execute, and merely needs an independent witness to be valid.
But why not write to your sister's creditors and advise them of the situation and see if they are prepared to merely write off the debt on grounds of compassion. It might be worth a try first, and then if necessary you can instigate the bankruptcy proceedings at a later stage.
So sorry to hear about her illness, and I do hope that things improve for you both soon. She is lucky to have such a kind and caring brother.
