I'll be made redundant soon after going bankrupt. When I do I'll receive a redundancy payout plus payment for 4 weeks notice pay from my company. I'll obviously need to inform the OR of this redundancy payout, but given that I will be unemployed, will the OR claim all of this redundancy money, or will I be able to keep some of it to live on?
According to a post I read on this forum, if I was to go bankrupt after I become redundant there's a better chance I'll be able to keep at least some of it to live on.
I'm afraid this is yet another grey area but for all the right reasons.
The fact is the OR has the legal right to claim every penny. Your fate relies entirely on the particular office and the particular examiner dealing with your case. However, one worth their salt will clearly see that to claim all whilst you have no income is placing you in a position of undue hardship which is not their role or their purpose.
