I am knee deep in debt with credit cards, store cards, catalogues etc. I also have a house which i dont live in as me and the wife seperated last year due to the stress of being in debt. She is also in debt. The question i have is :-

Do we apply for a joint BR or both do seperate ones. We both live seperate, but she is in the house. We have discussed this together and this seems to be the only option

Hi Paulm74

and welcome to the forum

It is really important to talk through the situation with someone to fully understand the process and consequences and perhaps also review all your options.

Are you looking to retain the house or has it significant negative equity.

Are you both on the mortgage or just yourself.

You will have to petition individually for bankruptcy but there is no reason why you can't go to court on the same day.

1st i would to thank you for the reply :)

We jointly own the house. As far as i am aware it is in negative equity.

So we must both file seperate BR's...cant we save money by doing joint ones???

I will try and ring tomorrow and discuss matters further with you.

you need to apply separately however if you were to apply together the Official Receiver may get a better picture of the situation and it may work better for you that way.
