I went bankrupt on 20th October last year and I have recently received 3 credit card statements with regards to different accounts with the bank of Scotland that I had.

They are not an actual request for money but statement does state that further action can be taken if I do not make the payments and states the amount outstanding.

I phoned Bank of Scotland and they said that by law they have to send statement out to me once a year. Surely this cannot be correct and is a complete waste of paper.

I thought the debt was written off when you go bankrupt. So why should the Bank of Scotland send me a statement stating the outstanding balance and explaining the consequences in not paying.

They told me the law had changed in October last year and they are obliged to send me statement every year. Makes no sense to me.

I want to put all this worry behind me and do not want reminding of my debt with these statements.

I have since ripped these statements up and thrown then in the bin.

Can any of the experts throw any more light on whether I should still be receiving statements?

If you were declared BR last year then the accounts should be closed. When you called did they acknowledge that you had been declared BR? I would mention this to your OR as all of the creditors should be dealing with him rather than directly with you.

All my creditors are aware that I went bankrupt last year and the OR as informed them all.

The Bank of Scotland told me that by law they still send statements out once a year just for information purposes. Again this cannot be right.

Funnily enough, I was declared bankrupt in Early March of this year and I am still receiving statements, together with information of the consequences of my non-payments and phone calls from my creditors. I received a phone call from the Bank of Scotland this morning and they were completely unaware of my bankruptcy and told me to phone another department who deals with bankruptcy. I was under the impression that the OR's office would have notified all my creditors by now. I know 2 months is not a long time, but I am a little concerned that none of my creditors seem to have been contacted as yet. Is this normal or should I contact my OR and let her know the situation.

I am not too suprised that you are still getting statements and phone calls 2 months after going bankrupt, but they will soon stop with a bit of luck.

I am talking about 6 months after bankruptcy. I have not had a credit statement from anyone for months then all of a sudden I get them from Bank of Scotland out of the blue, and they say it's the law to send these statements. I just do not know where they are coming from.

Well lets hope they soon stop sending these statements. As you said earlier, what a waste of paper for one thing amongst other things.

I too keep getting statements from the AA, even after 10 months of bankruptcy, called the OR and informed them about it as the AA said they wont stop sending them out until the OR informs them.
I have given up with them now, i get them once a month and they get shredded they are the only creditors that send anything i have had nothing from the others at all, last lot stopped at about month 3.
Oh well its at there expense not mine im not calling them anymore to advise its not for me to do so anymore, but if they do still hassle you then make sure you let your OR know as they can get onto these people and get them stopped.

It is actually correct - they are obliged to send out a stsatement at least once a year. This only came into being last year.

Just ignore them.

I agree, when i spoke to my company they were sending monthly and not once a year as they are supposed to do now under there new law change, they appologised and informed me of the new change which was noted and said they did not understand why they were sending monthly and not yearly statements. The new law came in about sept/oct last year i think it is linked to the consumer credit act too.

Hi all

I still do not understand why on earth they need to send out statements when you are bankrupt,and all correspondence with regard to this debt should go through the OR.

What does this new law say and what is achieved by sending out statements one a year.

Will I get these statements once a year for the rest of my life.

What a waste of paper.
