Hi everyone!

I am new to all this - my other half was in an IVA which failed. That was about 3 months ago and I have been having to motivate him into applying for a bankrupsy.

I just had a few basic questions. I am aware he can fill in the forms himself rather than going to a company and that it costs £510 (which we have been saving up to pay for!).

I wanted to know - how long does the overall process take?

Also, we rent a flat together (we are going to renew the contract soon) - will this be affected?

Finally will we have to be assesed together? I am in an IVA and would rather my finances were kept separate as there are things we pay down the middle, but other things we try to keep things separate.

Hi,

Welcome to the forum.

The time taken for the BR process will depend on your local court. With some courts you just turn up on the day with your forms and pay the fee, with others you need to book an appointment so contact your local court to find out their procedure.

Depending upon your rental agreement the OR may inform your landlord that your boyfriend has been declared BR so it may be better to mention this to the landlord/letting agency to see if there will be a problem. You can always reassure the landlord that you will be able to make the future rental payments as your boyfriend's job is secure or he is on benefits so has a regular income, etc.

You won't be assessed together so you can continue with your IVA.
