if the bank are going for a possession order b ecause I owe the money on loans that I have not paid. because i was going to do an iva but my husband lost his job. if I declared my self bankrupt would I be able to stay in my home

Hi Mothergoose,

Welcome to the forum,

The only creditors who can go for possession of your property are that of your mortgage company or any secured lender.

Secured debt is excluded from Bankruptcy therefore Bankruptcy would not stop the possession by a secured lender.

If debts are unsecured then these would be written off in Bankruptcy.

Could you perhaps post more information on the debts?
