Iam going to have to go bankrupt, iam in scotland.
i have no alternatives, iam unemployed and just scraping by on incapacity benefit etc, iam in council house, and apart from having a well kept and nice council house i have nothing else, no income or nothing, i have heard that in scotland that no ballifs etc can remove goods and stuff from the house, i would imagine thats correct, is it ?? thats one thing iam scared of as i said i have a nice house, i dont mean things are gold plated, lol, i just mean its nice.
I have no clue to what i do now, ive ran up many thousands of pounds worth of debts over the years and especially in the last few months, i think i got to the stage when i was saying to myself "to hell with it" and just spending credit card money willy nilly, but now its coming back to haunt me, i know what i have done is wrong, but when your on benefits etc and have several credit cards etc to spend on then you start to lose all sense of reality, well i did anyway.
Iam trying not to worry, but i do.
ive already had like loads of letters in the post demanding this that and the next thing, ive gave up even attempting to pay anything as iam at the end of my tether, i have not a coin to pay anything anyway.
What do i do, and where do i go and so on, iam so desperate now, the last count i done was maybe about £30,000, and now i feel iam going to get the jail, can someone help me please.

when i originally got all my credit cards and loans etc years ago (which i payed all the time), i pretended to be employed etc on the forms to get the cards and loans, does this mean iam going to jail too ??? i havent defrawded anyone, ive always payed, i just cant pay now, thats all. |

Hi,
The BR process in Scotland is slightly different and I believe that you have to be recommended to apply for BR rather than it being your own decision.
The first step is to speak to your local CAB as they will be able to assist and advise you of the BR process in Scotland. You won't go to prison for being BR or behind on your debts so don't worry. |

hi what do you mean i have to be recommened? who can do this for me ? and how soon do i need to do this?
iam clueless to all this, i know i can go speak to the cab but i was just hoping to try and learn some stuff before i take the deep plunge in, i am scared, who wouldnt be :( |

Hi
quite understandable but the rules and the process of bankruptcy are different in Scotland from those in the UK so I'm afraid I can't help.
CAB would seem the first port of call.

There are differences in the laws between England/Wales and Scotland so it would be better to speak to a Scottish based debt councilor. I have heard that you need to be recommended to declare BR in Scotland rather than deciding yourself however I may be wrong.
Calling the Scottish National Debtline (number on the link) will be your best bet. |
