Hello everyone I have just stumbled across this forum after doing the usual web search for bankruptcy info. I have finally made up mind to bite the bullet and petition for my own bankruptcy. I have part completed the forms, I have a 2nd appointment with the Citizens Advice Bureau next week to get the forms completed, and I have the £ to pay for it. Luckily I was able to get help from a charity to pay for the BR fee. So now things are starting to move, and although I feel some relief from simply deciding to actually do this, I am SO SCARED! My current income is just benefits. I get income support, child benefit and child tax credits. I have so many questions, and I'm staying awake at night worrying - don't think I can wait until my meeting with the CAB for answers!! So I'm hoping I might be able to get a few answers here.... Ok, so my benefits get paid into a post office account. Will that count be taken from me when the BR goes through? It has no credit or anything, it's just an account my benefits get paid into and withdrawn from.....as I'm worried if that close it then how do I get my benefits? I have no cash and my son and I live from the benefits so as you can imagine, I'm scared how we'd get by if I can't get them!!! Or how I sort out getting them if my PO account is closed....
I have no assets, just basic household items. Will there be someone who comes to my house to take anything they see as valuable? Not that I have anything of value, but the thought of someone coming round and taking things scares the hell out of me!! And if they do, what thing do they take? Will they take my tv?! My 2 year old with drive me mental without cbeebies to amuse him!
Also, I don't own a car, but I am insured on my sons fathers' car as when he visits I borrow his car. The form says I have to fill in details of any cars I use but don't own and now my sons father is angry that my BR will affect him so he's saying he wants to take me off the car insurance so I wont be able to use it anymore! I don't suppose that would be the end of the world, but worrying still. Oh, he says his car is only worth about £500, so is that not worth enough to be taken anyway?!!
Sorry for all questions, I'm just feeling scared and alone. I know I've made the right choice as my debts were getting out of control that I wasn't even buying food - I would pay all my debts first because I was so scared they'd send bailiffs if I didn't! It's just the getting through it part now with so many concerns....

Firstly please don't be worried or scared although I know it is easy to say. I went BR in April this year and spent a good 6 months beforehand worrying about it, making myself sick, but now wonder why, as it is really not as scary as it seems.
Ok, I can't imagine your post office account being closed after you file for bankruptcy. It is not the OR that closes the accounts only the banks so, I wouldn't of thought that would happen. The Co-op offers an account for bankrupts called the Cashminder account i set this up and told them i was going bankrupt and it was fine, i get my child benefit paid into that account with no problem, they also give you an electron card so you can pay for your goods that way too - maybe try giving them a call to put your mind at ease.
I haven't heard of anyone coming to your house to take your tv, they are only interested in expensive assets, which you would have to of listed on your petition - as you don't have anything it won't be an issue and no one will come to your home.
It doesn't matter that you are insured on someone else's car. The car belongs to someone else and it's not yours so they won't be interested in it at all. They weren't interested in my husbands.
Finally, the bankruptcy will not affect your partner at all and they are not interested in anything of his, unless the debts are in joint names. My husband has not been affected at all.
Please don't feel alone or scared, i know from experience how awful it can seem but once it is all over you will feel such a weight been lifted off your shoulders.
I'm a month into my bankruptcy and can finally see the end of the tunnel.

Thank you both so much for your replies, they've really helped.I am going to look into the co-op account straight away, I will also ring the post office as I'm guessing it might be the same. I can't even pay over the counter with my post office card - the only function it has is to withdraw my benefits so it sounds like it will be ok...willring and check though... Can you pay any direct debits with the co op account? I have to sort something for my tv licence etc as I have a barclays account to pay gas, tv licence, water etc via direct debit and I imagine that account will be closed....
I just can't wait for it to all be over, I want to stop feeling sick every day from worry!! I don't even answer my door anymore as I'm scared debt collectors will come knocking anytime as I've just stopped paying them on the advice of the Financial Advisor from the CAB!! That wasa really scary thing to do, but I hope it will all be going through soon...
As I said, I am meeting with the CAB next week so he can check my forms is filled in correctly, then get that sent off, any idea how long it could take for me to hear anything after that?

Yes you can pay direct debits from your cashminder account so no worries there. I was with Barclays and they do close your account as soon as they find out you are BR so please make sure you withdraw any money you have in there before going to court!
I stopped paying my credits 2 months before i went BR as had to get the money together to file my petition and no creditors ever came knocking and even if they do, all you need to do is say you are filing for bankruptcy and they should leave you alone! Once you are bankrupt your OR will deal with them all so you will never have to worry again.
Where are you based? I am in London and I went to the Royal Courts of Justice and it is a walk in service so you file your petition in the morning and when granted you go back in the afternoon to collect the stamped petition. After that it took 2 days for the OR to call me and go through a brief 20 min interview and then a week later I got a letter through the post for a face to face interview which lasted 2 hours, then haven't heard anything since! no news is good news!! don't worry about the face to face you probably won't get one, it's just i had a lot of debt!!

That depends on where you live. You will need to petition at your local court and this can take a few weeks. As cya mentioned if you are in London you can just walk into the RCOJ on whichever day you want. The CAB will be able to confirm your local court and then it is just a case of ringing/emailing them to find out their system and when you can petition. |

I'm in Bristol, don't think we have a walk in court...
So glad you told me that about Barclays, I usually always leave money in there for the gas, electric etc. I better go take that out asap and sort out a co-op account.
