I have just gone bankrupt and have nothing left.I can take that but have a couple of questions.1-Iwas a MD for prob the smallest ltd comp in existance but resigned late last year due to the inevitable personal bankruptcy. Now i am a employee and my son runs the business.We are in the construction industry and -well just above the benefit wage.But its better than JSA,having worked all my life.My son is looking after the business as the only director hope this is allowed as he wants as i do to keep it hoping things will improve oneday.I have my interview next week and wonder as i am due a underpayment of tax credits-due to terrible year whether to tell them i feel it may be best.As they will want it perhaps. Also my wifes bank account-as it only has benefits going in it,she has to ask the bank if they will keep it open,if they dont well shes panicking a bit.What happens if they freeze it immediatly.

Hi,

I can't help with the question about your tax refund, but if your wife hasn't gone bankrupt with you and the account is in her name, there shouldn't be a problem with it.

The OR will want the back payment I am afraid. When you went bankrupt you signed a legal undertaking to tell the OR of any changes to your income, which this is.

If your wife is not bankrupt and you are not on the account then the account will not be frozen.

If you would like your own account then you can open a Co-op Cashminder or a Barclays Cash account.
