| hi, i have been overpaid tax credits of £5400, & have to repay them. Can i include this in my bankruptcy? many thanks |

| yes you certainly can, as I did . Just put it as unsecured creditor. WOW £5400 is alot of overpayment, tax office = useless! LOL!! |

right, I'm currently disputing this with the Tax credits office, and so far, I;ve had two different stories.
1) Yes, if you have your Final Statement letter for the tax year you were overpaid in, if you haven't, then you are still liable.(sent by letter)
2) Yes, if they've sent letters saying you owe them XXX and to pay, or saying that they've asked for it and you still havent paid. (told on the phone, and my OR agrees)
so my advice is make sure you have the Final Statement for the appropriate year, so you avoid the nonsense I've got at the mo :D |
